No person, persons or corporation shall dig or excavate in the streets or public places without first obtaining a license as herein provided.

Whenever it is necessary to excavate or dig in public streets or public places for the purpose of repairing, replacing or installing mains, pipes, water laterals, drains and sewer laterals, or for any other purpose, the person, persons or corporation shall make a written application to the Clerk-Treasurer of the Village, for license or permit, which application shall describe the place or places to be dug or excavated, and such person, persons, or corporation shall deposit with the Village Clerk-Treasurer the sum of $1,000, to be retained as herein provided, and the Village Clerk-Treasurer is authorized to issue a license or permit to such applicant on complying with the conditions of this chapter.
Any person, persons or corporation excavating and digging in said streets shall replace the street in the same condition as before, the earth to be thoroughly tamped in place and in such manner as to leave no depression in the street, and the surface of the road to be replaced in as good condition as before and repaired with the same kind of material and in such manner as to leave no depressions or elevations in the road at the place of excavation, and said licensee shall notify the Street Commissioner when said repairs are completed, and it shall be the duty of the Street Commissioner to inspect said work and notify the Village Clerk-Treasurer of the fact, and after said street is replaced in as good condition as before the excavation, then the said Village Clerk-Treasurer shall return to the licensee the deposit made on granting the license. In the event said license does not repair and replace said street in as good condition as before the excavation, then it shall be the duty of said Street Commissioner to make the necessary repairs, and the labor and material used shall be a charge against the deposit made by the licensee, and such costs shall be deducted from such deposit and the balance returned to the licensee, but in the event said sum is not sufficient to pay for such labor and material, the balance of such cost shall be paid by the licensee.
Any person, persons or corporation excavating and digging the streets or public places shall erect barriers, signs and lights necessary to protect the public and persons lawfully on said streets or public places while excavations are being made, filled and road replaced.

Any person or persons violating the provisions of this chapter shall be punishable by a fine not exceeding $250, imprisonment for not more than 15 days, or both.
