[HISTORY: Adopted by the Township Council of the Township of Upper Darby 9-7-1976 by Ord. No. 2502. Amendments noted where applicable.]
For purposes of this chapter, the following definitions shall apply:
ALCOHOL
Ethyl alcohol of any degree of proof originally produced by the distillation-of any fermented liquid, whether rectified or diluted with or without water, whatever may be the origin thereof, and shall include synthetic ethyl alcohol, but shall not mean or include ethyl alcohol, whether or not diluted, that has been denatured or otherwise rendered unfit for beverage purposes.
PERSON
Includes any individual, whether a resident or nonresident of the Township of Upper Darby and whether male or female.
PUBLIC WAY OR PLACE
Every way or place of whatever nature located within the Township of Upper Darby, open to the use of the public as a matter of right for the purposes of vehicular or pedestrian travel.
It shall be unlawful for any person to willfully consume in or upon public ways or places within the Township of Upper Derby any beverage containing any percentage of alcohol whatsoever.

It shall be unlawful for any person to possess or transport any open container that contains an alcoholic beverage with any percentage of alcohol in or upon public ways or places within the Township of Upper Darby.

This chapter shall be enforced by the filing of a non-traffic criminal citation with the Magisterial District Judge with jurisdiction over the violation or as otherwise permitted by the Pennsylvania Rules of Criminal Procedure. Any person, firm, or corporation who violates the provisions of this chapter shall, upon being found guilty in a summary criminal proceeding, be sentenced to pay a fine of $300 plus any extraordinary expenses of the Township incurred in the prosecution of the criminal case.
