Disorderly conduct, as herein defined, is hereby prohibited
within the Township of Upper Darby.
A.Â
It shall
constitute "disorderly conduct" within the meaning of this article
to do any act, use any word, or employ any conduct causing or tending
to cause a disturbance of the peace and the good order of the Township
of Upper Darby or causing or tending to cause any danger to the inhabitants
of the Township of Upper Darby or users of any thoroughfare located
within the Township of Upper Darby.
B.Â
"Disorderly
conduct," within the meaning of this article, shall also include any
act, word or conduct tending to willfully obstruct, wholly or partially,
any street, sidewalk or portions thereof, any private walk of entrance,
public access to public facilities or to business establishments,
either personally or by vehicle or in any other manner.
C.Â
This article
shall include, within the meaning of "disorderly conduct," fighting;
drunkenness; the use of profane, indecent or inflammatory language,
except language recognized to be within the realm of protected speech
of the First Amendment to the United States Constitution; making of
unnecessary and unavoidable noise; spitting or expectorating upon
places or areas resorted to by the public; casting, throwing or placing
upon any portion of any sidewalk, public street, alley, vacant lot,
park, lake or playground any material or paper, ashes, dirt, rubbish,
litter or refuse substance; or the parking of any motor vehicle, attended
or unattended, in or adjacent to any park or recreation area during
the hours when such park or recreation area is not open for use by
the public; or any work, act or conduct prejudicial to the health
of the residents of the Township of Upper Darby or persons lawfully
within the Township of Upper Darby; or tending toward the destruction
of good morals as measured by the commonly accepted moral standard
prevailing throughout the Township of Upper Darby.

This article shall be enforced by the filing of a civil complaint
or by such other means as may be provided by the Pennsylvania Rules
of Civil Procedure. Any person, firm or corporation who violates any
building, housing, property maintenance, health, fire or public safety
code shall, upon being found liable in a civil proceeding, be ordered
to pay a penalty of not more than $1,000, plus the costs of prosecution,
plus all Township attorneys' fees incurred in the prosecution of the
civil case. Any person, firm or corporation who violates any other
ordinance shall, upon being found liable in a civil proceeding, be
ordered to pay a penalty of not more than $600, plus the costs of
prosecution, plus all Township attorneys' fees incurred in the prosecution
of the civil case. Each day that a violation continues shall constitute
a separate violation of this article. Each subsection of this article
that is violated shall constitute a separate violation of this article.

In the event that a person who violates the terms of the within article shall be a minor, less than 18 years of age, the person's parent, parents and/or legal guardian shall also be held liable for the payment of any fine levied against the violator pursuant to § 402-3 of this article.

The throwing and/or propulsion of a missile which is comprised
of snow and/or ice at a motor vehicle that is occupied by one or more
persons is herewith prohibited in Upper Darby Township.

This article shall be enforced by the filing of a non-traffic
criminal citation with the Magisterial District Judge with jurisdiction
over the violation, or as otherwise permitted by the Pennsylvania
Rules of Criminal Procedure. Any person, firm or corporation who violates
the provisions of this article shall, upon being found guilty in a
summary criminal proceeding, be sentenced to pay a fine of $300 plus
any extraordinary expenses of the Township incurred in the prosecution
of the criminal case.
In the event that a person who violates the terms of the within article shall be a minor, less than 18 years of age, the person's parent, parents and/or legal guardian shall also be held liable for the payment of any fine levied against the violator pursuant to § 402-5 of this article.
