1. 
Acts injurious to street trees. Except in the case of necessity for protection of life or property, it shall be a violation of this chapter for any person to do any of the following acts:
A. 
To cut down any street tree.
B. 
To interfere or damage through contact with the roots of any street tree.
C. 
To cut into, drive nails or spikes into, break, climb with spurs, or injure in any manner a street tree.
D. 
To place any rope, guy wire, cable sign, poster or other fixture on a street tree.
E. 
To injure, misuse, or remove any device placed to protect a street tree.
F. 
To discharge or pour salt, saltwater, oil, or other noxious liquids or materials on a street tree or around its base.
G. 
To place any stone, cement or other material on a street tree or around its base so as to impede the natural passage of water and air into its roots.
H. 
To attach any electrical wire, insulator, or any device for the holding of an electrical wire to any street tree without first obtaining a permit.
2. 
The topping of any and/or all trees within the Borough of Doylestown is not permitted.

Property owners are responsible for the costs of sidewalks and curbs damaged by existing street trees. Sidewalks and curbs shall be repaired by the property owner according to Borough ordinances, and sidewalks shall accommodate the existing street trees, their roots, and future growth needs.

The Borough, when removing a street tree for any reason, will restore the adjacent sidewalk as necessary at Borough expense. As a matter of standard practice, the stump will be reduced and ground down as flush with existing grade as possible. Any sidewalk repairs thereafter due to settlement from the decay of the residual stump and roots are the maintenance responsibility of the adjacent property owner.

Any person, firm or corporation who shall violate any provision of this ordinance shall be guilty of a summary offense and upon conviction be sentenced to pay a fine of $600 plus costs of prosecution. This shall be enforced by the Borough Manager and his/her duly authorized representatives.
