A. Persons selling fireworks in the City of Lake Ozark shall possess
a merchant's license, upon which there shall be noted permission to
sell fireworks under this Section.
B. The Chief of Police of the City of Lake Ozark shall inspect the premises
of each applicant for a merchant's license for the sale of fireworks,
and shall by his/her inspection ascertain the existence of the following
items before making a favorable report upon which a merchant's
license for the sale of fireworks shall be issued: The Chief of Police
shall inspect the premises and certify that the premises have a permanent
foundation, with permanent walls, ceilings, and roof; in addition,
the establishment hereby regulated shall keep on its premises a first-aid
kit for the treatment of wounds and burns.
C. Any person applying for a license to operate hereunder as a seller
of fireworks in the City of Lake Ozark shall furnish the City Clerk
with the location of the proposed establishment and will, upon granting
of a license to operate hereunder, adhere to this Section.
D. Failure to comply with this Section in selling fireworks without
a merchant's license to do so, shall subject the seller to a
fine of not less than ten dollars ($10.00) nor more than fifty dollars
($50.00) per day.

A. Definitions. As used in this Section, the following terms shall have
these prescribed meanings:
HIGHWAY
Any public thoroughfare for vehicles, including highways,
State roads, public streets, avenues, boulevards, parkways, or alleys
in the corporate limits of the City of Lake Ozark, Missouri.
MOTOR VEHICLE
Any self-propelled vehicle not operated exclusively upon
tracks.
OWNER
A person who holds the legal title of a motor vehicle or
in the event a vehicle is the subject of an agreement for the lease
or sale thereof, with or without the right of purchase upon performance
of the conditions stated in the agreement, and with an immediate right
of actual possession or control of a motor vehicle, the person named
as lessee or mortgagee in such agreement shall be deemed the owner
for the purposes of this Section.
SCHOOL BUS
A motor vehicle, either publicly or privately owned, used
to transport pupils properly chaperoned, to, and from any place for
educational purposes.
B. It shall be unlawful for any owner to engage in the business of hiring,
renting, or loaning of motor vehicles for a charge or fee upon the
highways within the corporate limits of the City of Lake Ozark, Missouri,
school buses excepted, without first obtaining a permit to so do from
the City of Lake Ozark, Missouri.
C. Before an owner shall be entitled to the permit mentioned in Subsection
(B) above, such owner shall file with the City Clerk of the City of Lake Ozark, Missouri, a certificate of insurance providing for a minimum of fifty thousand dollars ($50,000.00) liability insurance from a reliable insurance company approved by the Board of Aldermen, upon each passenger or rider, and a minimum of twenty-five thousand dollars ($25,000.00) property damage insurance from a reliable insurance company, approved by the Board of Aldermen, upon each vehicle.
D. The provisions of this Section shall not be applicable to commercial
vehicles operating under the control or supervision of the Division
of Transportation of the State of Missouri.

A. Definitions. As used in this Section, the following terms shall have
these prescribed meanings:
BAGNELL DAM STRIP
That part of Bagnell Dam Boulevard located within the City
limits of the City of Lake Ozark, Missouri, extending from the Bagnell
Dam south to School Road.
HORSE-DRAWN CARRIAGE
A carriage of traditional design with four (4) wheels, a
driver's seat or bench and a passenger compartment of such size
to accommodate no more than eight (8) passengers which is drawn or
pulled by no more than one (1) horse.
RIGHT-OF-WAY
That part of any public thoroughfare for vehicles including,
but not limited to, highways, State roads, public streets, boulevards,
avenues, parkways or alleys in the corporate limits of the City of
Lake Ozark, Missouri.
B. The Board of Aldermen, upon recommendation by the Planning and Zoning
Commission, may issue a maximum of two (2) business licenses to businesses
for the purpose of operating horse-drawn carriages on the Bagnell
Dam Strip.
1.
Each such business license shall permit the holder to operate
no more than two (2) carriages simultaneously.
2.
At no time shall a single business hold all available business
licenses of this type.
C. Application Procedures.
1.
Each applicant for this type of business license shall complete
an application form and submit it to the City Clerk with the following
documentation:
a.
Business license application form.
b.
A copy of a lease agreement demonstrating the location(s) where
the horse-drawn carriage will on-load and off-load passengers and
that said location(s) are off of any right-of-way.
c.
A certificate of insurance from a reliable insurance company
providing for a minimum coverage of one hundred thousand dollars ($100,000.00)
upon each passenger and one hundred thousand dollars ($100,000.00)
for property damage; or a certificate of insurance from a reliable
insurance company providing for a minimum coverage of one million
dollars ($1,000,000.00) for general business liability insurance.
d.
An application for a sign permit, including a copy of any proposed
signs that will be located at the location(s) where the horse-drawn
carriage will on-load and off-load passengers.
e.
A photograph of the actual or an identical carriage that will
be operated.
f.
The operator's plan for:
(1) Transportation of the carriage and the horse from
its holding area to the area of operation;
(2) Removal of animal waste from the right-of-way;
(3) Providing food and water to the horse during the
course of operations;
(4) Boarding horse(s) within the City limits, if applicable,
including, but not limited to, the location of such boarding, containment
of the animal(s), size of the area in which the animal(s) will be
contained, availability of food and water for the animal(s) and the
consent of the owner of the real property upon which the animal(s)
will be contained.
2.
The applicant shall present the application to the Planning
and Zoning Commission for its recommendation to the Board of Aldermen.
3.
Upon an approval recommendation of the application by the Planning
and Zoning Commission, the application shall be presented to the Board
of Aldermen for final approval.
4.
Upon approval of the application, the Board of Aldermen shall
direct the City Clerk to issue a business license to the applicant.
D. Each horse-drawn carriage operated in accordance with this Section
shall comply in all respects with Sections 307.125 and 307.127, RSMo.,
or any successive State Statutes relating to lighting requirements
and a triangular safety emblem on animal-driven vehicles.
E. Carriages shall be maintained and operated in a condition that provides
safe transportation of passengers along the Bagnell Dam Strip.
F. At no time shall the driver of any horse-drawn carriage, whether
a holder of this type of business license or not, stop a horse-drawn
carriage within the City limits for the purpose of on-loading or off-loading
of passengers on any City right-of-way.
G. Any person, firm, corporation or other entity operating a horse-drawn carriage in violation of this Section shall, upon conviction, be punished as set out in Section
100.220 of this Code. Each day's violation of this Section shall constitute a separate offense.

There is hereby required proof of trash service pickup on a
regular basis prior to the issuance of a license to operate a business
in the City of Lake Ozark.
