It shall be unlawful for any owner, custodian, or keeper of
a dog or dogs to allow or permit a dog to commit a nuisance on any
public property or on any private property which is detrimental to
the public health and welfare by reason of repeated barking, howling,
or yelping of any dog in such manner as to disturb or annoy persons
in the neighborhood.

Continuous barking, howling or making of other loud noises by
such dog for more than one-hour or continuous barking periods of less
than one-hour but more than 1/2 hour, which periods occur on two or
more consecutive days, and which annoy or disturb a reasonable person
of reasonable sensitivities shall be deemed a public nuisance.

Any owner, custodian, or keeper of any dog who shall violate
any of the provisions of this Part, upon conviction thereof in an
action brought before a magisterial district judge in the manner provided
for the enforcement of summary offenses under the Pennsylvania Rules
of Criminal Procedure, shall be sentenced to pay a fine of not less
than $25 nor more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 90
days. Each day that a violation of this Part continues or each section
of this Part which shall be found to have been violated shall constitute
a separate offense. No penalty under this section shall be imposed
upon any owner, custodian, or keeper for a violation of this Part
unless written warning of such action has first been served upon such
person or mailed to him 30 days prior to instituting proceedings and
unless a written complaint of such violation has been made to the
owner, custodian, or keeper.

Animals employed for use of law enforcement or employed for
the use of the disabled are exempt from the provisions of this Part.
