In order to effect a reasonable administration of this Part, a procedure is hereby instituted that will facilitate and expedite the processing of an access corridor transfer.

Upon receipt of an applicant's request for a review of a proposal, the Gregg Township Board of Supervisors shall make a determination as to whether or not the proposal is of a size and scope having only minor community impact.

Processing under this policy may be denied by the Gregg Township Board of Supervisors whereby the subdivision is determined to create a significant impact which would be inconsistent with the stated purpose of this policy which is to create an exemption to the subdivision plan processing procedure allowing for the creation of an access corridor parcel deemed to be of minor nature and scope.

1. 
Submission Process. The applicant shall submit for review the following:
A. 
A completed "request for information" form.
B. 
A detailed sketch plan showing the parcel to be subdivided from the present property and the nature of the proposal. The property owner must own the adjacent property for a consolidation or lot addition to be created, with the "common boundary line" to be deleted in a clear and concise manner.
The Gregg Township Board of Supervisors considers a lot addition to be any two or more separate adjacent lots where boundary lines are actually being moved within one or more of the properties, to increase or decrease the acreage of either lot. They consider the mere removal of a common boundary line to create a single lot to be a consolidation. If the property owner/applicant does not own adjacent property, then a lot addition or consolidation is not being created. Under any of the outlined circumstances, the property is subject to all of the applicable rules and regulations outlined in the Gregg Township Subdivision Ord. 11-75, its amendments, its supporting resolutions, and any policies created by the Gregg Township Board of Supervisors now in effect or in effect at the time of the submission.
C. 
Applicant shall produce evidence of ownership (i.e., source of title) and will be required to produce an "accurate description" of the parcel being subdivided (by bearings and distances generated by a registered surveyor or equivalent alternative such as a railroad center-line easement stationing or PennDOT center-line descriptions).
D. 
Applicant shall execute a disclaimer statement in substantially the following form:
"Applicant understands that Gregg Township government, by requiring compliance with the Municipalities Planning Code of the Commonwealth of Pennsylvania and the Subdivision Ordinance of Gregg Township; does not guarantee applicant's title to the property recited in the document of transfer. Applicant shall be responsible to verify title through a title examination through a lawyer. Applicant waives any claim, action, cause of action, or demand, it may have now or in the future may obtain against Gregg Township government, its agents and employees, for any damages or costs applicant may incur in obtaining good title to the property."
E. 
Upon receipt of the above information, the Gregg Township Board of Supervisors, within 10 working days after their next scheduled meeting, shall render its determination as to the status of the proposal and declare whether the subdivision falls within the criteria established in this policy.
F. 
If the decision is favorable:
(1) 
The application, detailed sketch plan, and other submitted documentation will be acknowledged as "granted approval" and will be placed on file as such with no further submission requirements.
(2) 
The applicant shall be notified in writing, and the appropriate agencies shall similarly be notified concerning the Gregg Township Board of Supervisors' determination. All applicable parties (e.g., local municipal officials, Centre County Assessment Office, Recorder's Office, the Pennsylvania Department of Transportation, and the Gregg Township Sewer Authority) will be provided with a copy of the detailed sketch plan, corresponding survey documentation and source of title for their files.
(3) 
Applicant will be instructed that the determination does not negate the responsibility to comply with the County's Uniform Parcel Identifier Ordinance and/or all other applicable federal, state or municipal rules and regulations prior to deed transfer and recording.
G. 
If the decision is unfavorable:
(1) 
The applicant will be notified in writing and the appropriate agencies will be similarly notified of the Township's decision.
(2) 
The decision of the Township may be appealed as permitted by law.

Gregg Township shall require a signature block on all future plans for the Gregg Township Zoning Officer, to read as follows:
"This plan meets or exceeds all Gregg Township zoning requirements at the date of signing."
2. 
This signature block will be proof of the written concurrence from the Gregg Township Zoning Officer in lieu of a separate zoning letter. See sample below.
