There is hereby established a Department of Public Works, the head of which shall be known as the "Superintendent of Public Works." The Department shall consist of two units:
A. 
Maintenance: responsible for all streets, roads, storm sewers, public property and equipment repair; and
B. 
Water and Sewer: responsible for all public water connections, water purity and all gravity-fed sanitary sewers.
A. 
Creation of office; appointment. The office of Superintendent of Public Works ("Superintendent") is hereby created. The Superintendent shall be appointed by the Mayor with the advice and consent of the Borough Council.
B. 
Qualifications. In order to qualify for appointment to the office of Superintendent of Public Works, the person must hold a valid public works manager certificate issued by the State of New Jersey or obtain the same within two years of initial appointment, in accordance with state statute, unless otherwise exempted by law.
C. 
Duties; supervisions. The Superintendent shall be in charge and control of the Department of Public Works and report directly to the Administrator. In the event of the Superintendent's extended absence due to disability or otherwise, the Mayor, with the advice and consent of the Council, shall appoint a temporary successor to fill the position until the Superintendent is able to return to work. During the Superintendent's vacation time or sick leave, the Superintendent shall designate a member of his/her department to assume his/her duties and powers and shall notify the Administrator of such designation in writing. The Superintendent of Public Works shall be in charge of and have supervision over:
(1) 
Parks and public property;
(2) 
Roads and streets;
(3) 
Road equipment trucks and materials;
(4) 
Storm sewers;
(5) 
Sanitary sewers;
(6) 
Water services; and
(7) 
Observation of private property for adherence to Borough ordinances.
D. 
Additional duties.
(1) 
The Superintendent of Public Works may be requested to make minor repairs to Borough roads and for the maintenance of police and fire equipment. The Public Works Department shall assist all other departments, committees, boards, and agencies, to the best of its ability and skill sets, by providing skilled labor and knowledge.
(2) 
The Superintendent shall discharge such other duties as the Administrator may request from time to time, consistent with the duties specifically set forth in this section.
There is hereby created the position of Foreman of the Department of Public Works. The duties and responsibilities of the Foreman shall include the following:
A. 
As directed and delegated by the Public Works Superintendent, to participate, supervise and direct at job and project sites the work of the other employees of the Department of Public Works.
B. 
In the event of the absence of the Public Works Superintendent due to illness, vacation or otherwise, to perform such additional supervisory duties and functions as may be assigned.
C. 
To operate and supervise the operation of all equipment and vehicles under the jurisdiction and control of the Department of Public Works in order to carry out the various public works projects and specific jobs and tasks for which the Department of Public Works is responsible.
D. 
To perform such other duties, assignments and work, including, but not limited to, training and assisting other employees of the Department on the performance of manual labor and the various other tasks as are required of such other employees, in order to carry out the functions and responsibilities of the Department of Public Works in an adequate, efficient and timely fashion.
E. 
To perform such other duties and tasks as may from time to time be requested of the Foreman by the Public Works Superintendent.
There is hereby created the position of Water/Sewer Foreman who shall supervise all water and sanitary sewer activities and who shall be directly responsible to the Superintendent. The Water/Sewer Foreman shall hold such qualifications as are established by the Borough and shall have such duties and responsibilities as are delegated by the Superintendent. The duties and responsibilities of the Water/Sewer Foreman shall include the following:
A. 
Under direction of the Superintendent, install, maintain, repair, operate, administer and care for the Borough's water and sewer systems and lines and appurtenances, including, but not limited to, the installation, repair and replacement of water meters; location and repair of water leaks and frozen pipes; provide and maintain such reports and records as may be required in providing water and sewer service to Borough residents; and conduct such tests as may be necessary to properly operate and maintain the Borough's water and sewer systems.
The titles of Public Works Operator and Public Works Laborer are hereby created, and such appointments to each as may be deemed necessary by the Mayor and Council shall be made from time to time. Such personnel shall be under the supervision of the Superintendent or the Foreman during the Superintendent's absence. Their qualifications shall be in accordance with the job descriptions established for each by the Borough and shall have such duties and responsibilities as are required by their superiors to accomplish the goals and objectives of the Department.
There shall be such other positions in the Department of Public Works as may from time to time be established by the Borough Council by providing a salary or rate of pay for same as part of the annual Salary Ordinance,[1] or any amendment thereto.

When Borough property or infrastructure is damaged by a third party due to accident, improper use or maintenance or similar circumstances, the Superintendent, with the consent of the Administrator, may assign members of the Public Works Department to make repairs, as needed, to return the property to its original condition. Such repairs, when necessary, shall be made at the expense of the third party causing said damage. The hourly rate to be charged for repair or maintenance work shall be $75 per hour for personnel plus an administrative fee of $12 per hour. Additionally, reasonable and appropriate charges for equipment and materials may also be charged to the responsible persons or entities.
