This article is enacted pursuant to § 66.0608, Wis. Stats., to authorize and provide use, reporting and accountability of volunteer funds received or raised over time in the name of the Cedar Grove Fire Department or First Responders and to authorize and define such accounting, withdrawals and expenditures by the Fire Department or First Responders. Volunteer funds include donations, raised funds, and allocations from community fund-raising for the benefit of the Fire Department or First Responders.
The Village of Cedar Grove and Town of Holland boards, pursuant to § 66.0608, Wis. Stats., hereby authorize the Cedar Grove Fire Department and First Responders, by their respective treasurers, to deposit volunteer funds in depository accounts in the name of the Cedar Grove Fire Department or First Responders. The banking institution where these depository accounts shall be held may be determined from time to time by the Cedar Grove Fire Department or First Responders, with joint approval of the Village and Town boards.
As provided by § 66.0608(3), Wis. Stats., the following are limitations and requirements with regard to handling and disbursement of the volunteer funds from the Cedar Grove Fire Department and First Responders depository accounts as created in this article:
A. 
Control of funds. The Cedar Grove Fire Department and First Responders, by their respective treasurers, have control over the expenditure of funds from deposits made to those accounts from volunteer funds deposited to those accounts.
B. 
Expenditures. Expenditures of volunteer funds of the Cedar Grove Fire Department and First Responders may be made upon a majority vote of the Fire Department or First Responders officers at a duly noticed meeting of the officers. Those expenditures may be made for any project, daily expenses or events that relate to the operations and purpose of the Cedar Grove Fire Department or First Responders. The scope of operations and services shall not be expanded without joint approval of the Village and Town boards. Any equipment purchased shall be maintained using volunteer funds and owned by the Cedar Grove Fire Department or First Responders.
C. 
Accounting and reports. The Cedar Grove Fire Department and First Responders shall provide annual statements and reports to the Village of Cedar Grove and the Town of Holland boards. The annual statements shall include an itemization of all receipts, expenditures and the balance on hand at the end of each year. Sufficient detail shall be provided by the Cedar Grove Fire Department and First Responders to the Village of Cedar Grove and Town of Holland to enable maintaining records of the Fire Department and First Responder volunteer funds. On the complete inventories of all Cedar Grove Fire Department and First Responders equipment and material valued at $500 or greater each, all items procured using volunteer funds shall be identified as such. If any equipment is removed from service, any funds received shall be considered consistently with the funds used to initially procure such equipment.
D. 
Audits. The volunteer funds of the Cedar Grove Fire Department and First Responders shall be audited annually during a joint meeting of the Village of Cedar Grove Fire, Law and Safety and the Town of Holland Public Safety Committees. In addition to reviewing the financial aspects to verify consistency with this article and proper accounting practices, the audit shall include a review of the equipment and material inventories to highlight the benefits provided by volunteer funds expenditures.
E. 
Limit to amount of expenditures. Notwithstanding the provisions referenced above, there shall be no expenditure in excess of $10,000 for any single disbursement or purchase unless so approved by a majority vote of both the Village of Cedar Grove and Town of Holland boards.
F. 
Ownership of funds. Notwithstanding the terms and authorization provided in this article, volunteer funds and other raised dollars held in the account of the Cedar Grove Fire Department or First Responders shall be considered as joint property of the Village of Cedar Grove and Town of Holland until the funds are disbursed.
G. 
Other Fire Department contracts and agreements. This article is not intended to in any way change the organization or responsibility of the Village of Cedar Grove and Town of Holland which are responsible under § 60.55, Wis. Stats., for fire protection for the Village and Town residents and which have approved the Cedar Grove Fire Department and First Responders organizations and purposes. Any proposed agreements between the Cedar Grove Fire Department or First Responders with other municipalities to provide fire and related emergency services to other municipalities shall be evaluated and recommended by the Cedar Grove Fire Department or First Responders, subject to joint approval by the Village of Cedar Grove and Town of Holland boards.

The intent of this article is to implement regulations consistent with nationally recognized good practice for the safeguarding to a reasonable degree of life and property from the hazard of fire and explosion arising from the storage, handling, sale and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the use or occupancy of buildings or premises.
A. 
Except when otherwise specifically provided in this article, the regulations contained in this article shall apply to all buildings, structures and premises covered under Chs. Comm 61 through 65 and 76 through 79 of the Wis. Adm. Code except:
(1) 
One- and two-family dwellings and accessory buildings.
(2) 
Temporary buildings or sheds used for construction purposes only.
B. 
However, if any building, structure or premises, whether excepted in Subsection A or not, is especially liable to fire or is so situated as to endanger other buildings or property or contains any combustible or explosive material dangerous to the safety of any building, structure or premises or the occupants thereof or endangers or hinders firefighters in case of fire, such building, structure or premises shall not be exempt.
The chief of a fire department is empowered to designate the number, type and location of fire extinguishers and other fire-protection equipment as may be deemed necessary in any building or structure or any building or structure under construction.
A. 
The chief or any authorized fire inspector of a fire department may, at all reasonable hours, enter any building or premises governed by this article for the purpose of making any inspection or investigation which, under this article, they deem necessary to be made.
B. 
Any person who refuses to permit or prevents or interferes with any entry into or upon the premises by any such inspector or who interferes with any such inspection shall be deemed guilty of violating this article.
A. 
The chief of a fire department may order the compliance with the regulations of this article and all other laws and lawful orders relating to fire protection and fire prevention in all existing buildings and structures governed by this article.
B. 
The chief of a fire department may close any building or structure and order it vacated, wherein violation of any section of this article is found and not corrected within a reasonable time stipulated by them or by any authorized fire inspector.
C. 
Where the public is exposed to immediate danger, the chief of a fire department may order the closing and vacating of the building, structure or premises at once.
A. 
The chief of a fire department shall inspect or cause to be inspected by an authorized fire inspector all buildings, structures and premises, except as otherwise provided in this article, for the purpose of ascertaining and causing to be corrected any conditions liable to cause fire or any violation of any law or lawful order relating to the safeguarding of life and property from the hazards of fire and explosion; the handling, storage, sale and use of hazardous substances, materials and devices; conditions hazardous to life and property in the use of occupancy of buildings, structures or premises; and the safety of firefighters in the performance of their duties.
B. 
Such inspections shall be conducted at least once per calendar year, provided that the interval between those inspections does not exceed 15 months. The fire chief may require more frequent inspections for buildings they, in their discretion, deem as being high risk. Those occupancies deemed high risk may include, but are not limited to, places of assembly with occupant loads of more than 100; schools; day-care centers; nursing homes; congregate care facilities (with or without nursing staff); or any facility required to be inspected that has reoccurring noncompliant fire code violations.
Whenever any inspector shall find in any building or structure or upon any premises combustible waste materials or explosive matter which is so situated or used so as to endanger life or property or shall find in any building or structure obstructions of exits or storage of material on or in fire escapes, stairs, passageways, doors or windows, which obstruction or storage would interfere with the operations of the fire department or interfere with the safe egress of occupants in case of emergency, they may order such removed or remedied.
Whenever any inspector shall find any building or structure which, for lack of repairs or required exits or required fire alarm systems or required fire-extinguishing equipment, appliances or devices or maintenance thereof or which is especially liable to fire from any cause whatsoever and which is so situated as to endanger the occupants thereof or endanger adjacent property and whenever any inspector shall find in any building or structure or upon any premises any violation of this article, they may order such violation discontinued at once and order the removal of conditions dangerous to the safety of any such building, structure or premises or the occupants thereof.
Any order issued under this article shall be complied with by the owner and occupant of the building, structure or premises concerned within the time prescribed in such order.
