A.
Every
person convicted of a traffic infraction for a violation of any provision
of this chapter which is not a violation of any provision of the Vehicle
and Traffic Law of the State of New York shall be subject to the following:
B.
Upon the
failure of a person or owner of a vehicle to appear to answer a summons
on or before the return period or any subsequent adjourned date, late
penalties shall be imposed as follows:
(1)
If
the aforementioned fine shall not be paid within 30 days from the
date the summons was issued, a late penalty equal to the original
fine shall be added to the fine; and
(2)
If
the fine is still not paid within 60 days from the date the summons
was issued, an additional late penalty in an amount equal to the original
fine shall be added to all fines and penalties previously assessed;
and
(3)
If
the fine is still not paid within 90 days from the date the summons
was issued, an additional penalty of $30 shall be added to all other
fines and penalties previously assessed.
A.
Except those parts, if any, which are subject to approval
under § 1684 of the Vehicle and Traffic Law of the State
of New York, this chapter and any regulations adopted hereunder shall
take effect as provided by law.
B.
Any part or parts of this chapter and any regulations
adopted hereunder which are subject to approval under § 1684
of the Vehicle and Traffic Law of the State of New York shall take
effect from and after the day on which approval in writing is received
from the New York State Department of Transportation.[1]
