[HISTORY: Adopted by the Board of Chosen Freeholders of Mercer County as Ch. 2.07 of the 2003 Mercer County Code. Amendments noted where applicable.]
[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code of Mercer County has been amended to delete the term “Board of Chosen Freeholders” and replace it with the term “Board of County Commissioners.” In addition, the terms “Freeholder” and “Chosen Freeholder” have been deleted and replaced by the term “County Commissioner.”]
Pursuant to New Jersey Statutes, the positions of Superintendent of Elections and Deputy Superintendent of Elections are created.
The Superintendent of Elections and the Deputy Superintendent of Elections are to be nominated by the Governor with the advice and consent of the Senate, and the Deputy Superintendent of Elections is not to be from the same political party as the Superintendent of Elections.

The term of office of the Deputy Superintendent of Elections is to be five years. It shall run concurrently with the Superintendent's term. The initial appointment of the Deputy Superintendent shall be for a partial term if appropriate.

The powers and duties of the Superintendent of Elections shall be as set forth by statute. The powers and duties of the Deputy Superintendent of Elections include assisting the Superintendent of Elections in the performance of his/her duties, and serving as a Superintendent in the absence of the Superintendent, and fulfilling any other powers and duties delegated to him/her by the Superintendent.

The salary of the Superintendent of Elections shall be established as set forth by statute, N.J.S.A. 19:32-26.1. The salary of the Deputy Superintendent of Elections is to be 90% of the salary of the Superintendent of Elections.

A. 
Any person filling a vacancy in the office of the Superintendent of Elections or Deputy Superintendent of Elections shall be from the same political party as the original appointee, and be appointed in the same manner as the original appointee. Appointments shall be for the unexpired term.
B. 
If the position of Deputy Superintendent of Elections becomes vacant, the Superintendent is to advise the Secretary of State of the vacancy.

All conditions set forth in the state law shall apply to the Superintendent of Elections and to the Deputy Superintendent.
