[HISTORY: Adopted by the Board of Chosen Freeholders of Mercer County as Ch. 2.19 of the 2003 Mercer County Code. Amendments noted where applicable.]
[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code of Mercer County has been amended to delete the term “Board of Chosen Freeholders” and replace it with the term “Board of County Commissioners.” In addition, the terms “Freeholder” and “Chosen Freeholder” have been deleted and replaced by the term “County Commissioner.”]

There is established in Mercer County the Mercer County Construction Board of Appeals, which shall consist of five members to be appointed by the County Executive with the advice and consent of the Board of County Commissioners. Members shall be residents of the County, who shall be qualified by experience or training, to perform the duties of members of the Construction Board of Appeals. The County Executive shall designate one member to be the Chairman. There shall also be five alternate members pursuant to N.J.A.C. 5:23A-1.3(d). All members shall possess the qualifications set forth in N.J.A.C. 5:23A-1.3(b). Pursuant to N.J.S.A. 52:27D-127, in addition to the five members, the Board shall include two special members, a licensed professional engineer with municipal construction experience and a builder, who shall serve as additional members in any case involving an appeal of municipal fees.
Members of the Mercer County Construction Board of Appeals shall serve without compensation but shall be entitled to reimbursement for expenses actually and necessarily incurred in the performance of their duties.

Vacancies on the County Board of Appeals shall be filled in the same manner as the original appointment was made, but for the unexpired term only.

The Board may, within the limits of funds appropriated or otherwise made available to it for the purpose, employ such professional, technical, clerical or other assistants, and incur such expenses as may be necessary for the performance of its duties. The County Executive shall appoint a Secretary for the Board who need not be a member of the Board.

The Board shall function and is authorized to act in accordance with the provisions of the State Uniform Construction Code Act and particularly to N.J.S.A. 52:27D-127 (Section 9 of the Act).

The Board authorizes a fee for applications before the Mercer County Construction Board of Appeals in the sum of $100.
