[HISTORY: Adopted by the Board of Chosen Freeholders of Mercer County as Ch. 2.28 of the 2003 Mercer County Code (Ord. No. 88-27). Amendments noted where applicable.]
[Pursuant to P.L. 2020, c. 67, effective 1-1-2021, the Code of Mercer County has been amended to delete the term “Board of Chosen Freeholders” and replace it with the term “Board of County Commissioners.” In addition, the terms “Freeholder” and “Chosen Freeholder” have been deleted and replaced by the term “County Commissioner.”]
A. 
There is created the Hamilton Duck Island Advisory Commission.
B. 
The Hamilton Duck Island Advisory Commission shall be an advisory body subject to Chapter 3.01, Boards, Commissions and Agencies Generally, of the Code of Mercer County, assigned to the office of the County Executive.
The Hamilton Duck Island Advisory Commission shall consist of 17 members who shall be appointed by the County Executive with the advice and consent of the Board of County Commissioners. The members shall include:
A. 
Five members who shall serve by virtue of their office:
(1) 
The County Executive or his/her designee;
(2) 
The President of the County's Solid Waste Advisory Committee (S.W.A.C.);
(3) 
The Mayors of Hamilton Township and the City of Trenton or their designee; and
(4) 
The Executive Director of the Mercer County Chamber of Commerce or its replacement.

B. 
Twelve members which shall include the following:
(1) 
A representative of the State Department of Transportation;
(2) 
A representative of the State Department of Health;
(3) 
A representative of Westinghouse;
(4) 
A representative of the private sector, solid waste disposal industry;
(5) 
Seven residents of the County including at least three residents of the Southwest Hamilton/South Trenton area;
(6) 
At least one senior citizen; and
(7) 
At least three residents from the County-at-large who are solid waste rate payers.
All citizen appointments shall be made for the terms of three years after initial appointments, which shall be made as follows: three members for one-year terms; three members for two-year terms; and three members for three-year terms. A member shall be eligible for reappointment for not more than two consecutive terms. A vacancy in the membership occurring other than through expiration of a term shall be filled in the same manner as the original appointment but for the unexpired term only.
The Commission shall meet as soon as practical following the appointment of its members and shall elect a chair from among its members and establish procedures for the conduct of regular and special meetings in accordance with the Open Public Meetings Act.[1]

The Commission shall meet at least four times each year. Its activities shall include, but not be limited to:
A. 
Maintaining a liaison between the developers of the facility, the governments and the residents of the County;
B. 
Being a repository of information to which the citizens of the County might refer;
C. 
Disseminating information regarding proposals, development and construction of the facility and surrounding area to the public at large.
No action of the Hamilton Duck Island Advisory Commission shall be binding upon the Mercer County Board of Commissioners or the County Executive unless and until such action has been duly approved by the Commissioners and the County Executive. No recommendation by the Hamilton Duck Island Advisory Commission shall create a financial obligation on the part of the Mercer County governing body unless and until that body has approved the creation of a financial obligation in the manner provided by law.
