As used in this article, the following terms shall have the meanings indicated:
ELECTRIC VEHICLE
Any vehicle that operates, either partially or exclusively, on electrical energy from the grid, or an off-board source, that is stored on board for motive purpose. "Electric vehicle" includes:
A. 
A battery electric vehicle;
B. 
A plug-in hybrid electric vehicle;
C. 
A neighborhood electric vehicle; and
D. 
A medium-speed electric vehicle.
ELECTRIC VEHICLE SUPPLY EQUIPMENT (EVSE)
Electric charging facilities for electric vehicles, commonly consisting of a connection to the electrical grid, power supply cables, a mount, and connection to vehicle. An EVSE shall be comprised of all equipment that connects a motorized electric vehicle to the electrical grid.
A. 
Provisions in this article shall be applicable only to EVSE located on public property or in public rights-of-way.
B. 
Nothing in this article shall be construed so as to exempt electric vehicles from vehicle rules and regulations set forth elsewhere in Ventnor's ordinances.
C. 
Nothing in this article shall be construed so as to prohibit the installation of private electric vehicle supply equipment for the charging of vehicles parked on private property.
D. 
This article shall not apply to low-speed vehicles, classified as such by the State of New Jersey Motor Vehicle Commission.
A. 
The provision of on-street parking spaces for electric vehicles using EVSE is hereby established.
B. 
Parking spaces for charging electric vehicles established in this article shall be those located adjacent to those sited and installed by the City of Ventnor. Siting shall be subject to the consultation of the Chief of Police, Director of Public Works, City Engineer, and City Planner.
C. 
These parking spaces shall be marked with official signage pursuant to §§ 217-27 and 217-28 of this article.
D. 
Parking in these spaces shall be limited to actively charging electric vehicles. Electric vehicles are not permitted to park in spaces designated for electric vehicle charging if the vehicles are not plugged in and charging. Owners and operators of nonelectric vehicles or noncharging electric vehicles parked in an electric vehicle charging parking space shall be considered in violation of this article.
E. 
The Commissioners of the City of Ventnor shall be permitted to establish a fee schedule for charging costs at the consultation of the City's engineering, planning, and financial staff.
F. 
The Commissioners of the City of Ventnor shall be permitted to lease and/or purchase services related to the installation, maintenance, and operation of public EVSE.
A. 
EVSE shall be set back at least 1.5 feet from the face of the curb if installed for an on-street parking space.
B. 
A concrete bollard three feet in height shall be installed on the street-facing side of the EVSE located between the equipment and the curb.
C. 
EVSE shall be mounted on a device no taller than four feet and shall contain a retraction device and/or place to hang permanent cords and connectors.
D. 
Lighting sufficient to operate the EVSE shall be provided at all hours. A light sensor shall be installed to automatically adjust lighting levels.
E. 
Parking spaces with EVSE facilities shall be outlined in the street pavement in green-striped paint.
F. 
EVSE shall be ADA-accessible.
A. 
The Chief of Police shall, at the consultation of the City's engineering, planning, and public works staff, erect signage indicating the presence of electric vehicle supply equipment at the equipment's site/parking space.
B. 
Signage shall indicate the limitations and conditions of the space's use, a contact number for reporting malfunctions, a reference to this article's violations/penalties, and that the space is reserved for charging electric vehicles only.
C. 
Signage shall be mounted on top of the EVSE and be two sided. The sign shall not exceed 24 inches by 24 inches in length and width.
Any individual, person, or entity found guilty of a violation of this article shall be subject to penalties described at § 217-14.
