As used in this chapter, the following terms shall have the meanings indicated:
CONSUMER FIREWORKS
The term includes any combustible or explosive composition or any substance or combination of substances which is intended to produce visible or audible effects by combustion, is suitable for use by the public, complies with the construction, performance, composition and labeling requirements promulgated by the Consumer Products Safety Commission in 16 CFR (relating to commercial practices) or any successor regulation.
It is illegal for any person to use, including but not limited to igniting or discharging consumer fireworks on the streets of the City of Easton, the sidewalks of the City of Easton or any property owned by the City of Easton, including, without limitation, all of the City's parks and public buildings; or on any property within 150 feet of a building or vehicle; whether or not the building or vehicle is owned by the user of the fireworks.
Local authorities will confiscate any unused fireworks to the extent authorized by Pennsylvania law.
The staff of the City of Easton be and hereby are directed to provide certified copies of this chapter to all magisterial district judges within the City of Easton to provide judicial notice that no permission has been granted by the City for any person to intentionally ignite or discharge consumer fireworks on the City streets and sidewalks or on any real estate owned by the City of Easton.
Violations and penalties for the illegal use of fireworks in the City of Easton is $500 and repeat offenders, within three years are considered third-degree misdemeanors and carry a fine up to $1,000.
