The purpose of this chapter is to provide for the appointment of a single appointed Assessor in the Town of Amenia pursuant to § 328 of Article 3 of the Real Property Tax Law of the State of New York ("Real Property Tax Law") and to abolish the elective office of single Assessor.
Former Chapter 4 of the Code of the Town of Amenia, entitled "Assessors," being Local Law No. 3 of 1997, is hereby repealed in its entirety upon the effective date of this chapter.
The office of single elected Assessor, as previously established by the Town of Amenia by Local Law No. 3 of 1997, is hereby abolished. The term of office of the single elected Assessor, which is currently vacant, shall terminate on April 5, 2018, a date within one year following which this chapter was adopted.
If any clause, sentence, paragraph, subdivision, or part of this chapter or the application thereof to any person, firm or corporation, or circumstance, shall be adjudicated by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this chapter or in its application to the person, individual, firm or corporation or circumstance directly involved in the controversy in which such judgment or order shall be rendered.
This chapter shall take effect immediately upon filing with the Secretary of State pursuant to § 328 of the Real Property Tax Law, and the term of the position of single elected Assessor shall terminate on April 5, 2018, and the term for the single appointed Assessor shall commence on April 6, 2018.
