There be and is hereby created within the Township of Maplewood patio dining.
As used in this article, the following terms shall have the meanings indicated:
PATIO DINING SPACE
An outdoor space with tables and chairs located within a publicly owned parking lot, plaza or square, to be used for dining and musical performance and other artistic events.
A. 
The purpose is to establish a procedure and authorize rules and regulations for patio dining space, as herein defined, in the Maplewood Village and Springfield Avenue Special Improvement Districts of the Township.
B. 
Patio dining space may only be sponsored by the Township's Special Improvement District Management Corporations (SIDS) and is limited to two evenings per week. Patio dining spaces are designed for patrons to bring their own food and drink, although the SIDS may arrange for food trucks. The SIDS shall immediately address any public nuisance issues that impact the health, safety and welfare of the community.
Patio dining space patrons may consume only beer or wine which is brought to the premises by the patrons, providing the patrons also bring food for consumption.
An event application shall be required for a patio dining space. The application shall be submitted to the Township Clerk and signed by a SID District Manager.
The Township Clerk will review the application for completeness and compliance with the terms of this article and other Township ordinances and state and federal statutes. If the application is complete, the Township Clerk will forward the application to the appropriate Township Department Heads and officials, who will act upon same within 10 business days, after the application becomes complete. If the application is not complete, the Township Clerk will so notify the applicant within 10 business days of the submission and specifically detail the areas in which the application lacks compliance with requirements of this article.
If the application complies with all applicable laws, the Township Clerk shall issue an approval for the event.
A. 
Each SID is responsible for keeping the area of the patio dining space and the adjacent walks, plazas and streets free and clear of any debris or litter occasioned by the patio dining. Areas must be kept clean at all times.
B. 
The SID shall place a trash receptacle within the area of the patio dining space to allow patrons to properly dispose of debris or litter.
C. 
Within 60 minutes after the closing of the patio dining, the operator shall have all furniture, apparatus, decorations and appurtenances and any other items used in connection with the operation removed.
A. 
Patio dining shall be permitted year round.
B. 
Patio dining shall be limited to the hours of 5:00 p.m. and 10:00 p.m.
