There is hereby levied, assessed and fixed a license or occupation tax upon all recreation parlors and game rooms wherein automatic amusement devices, coin-operated amusement devices and non-coin-operated amusement devices are operated or conducted within the City of Portageville, Missouri, as hereinafter set out, same to be regulated as hereinafter provided.

As used in this Chapter, the following terms shall have these prescribed meanings:
AUTOMATIC AMUSEMENT DEVICES, COIN-OPERATED AMUSEMENT DEVICES AND NON-COIN-OPERATED AMUSEMENT DEVICES
Any machine or device, which, upon the insertion of a coin, trade token, or slug, operates or may be operated as a game or contest of skill for amusement of any kind or description, and which contains no automatic pay-off device for the return of money or trade token or slugs, or which makes no provision whatever for the return of money to the player. Furthermore, said devices are hereby further defined as any machine, apparatus, or contrivance which is used or which may be used as a game of skill and amusement wherein or whereby the player initiates, employs or directs any force generated by the machine or apparatus.
PERSON
Includes any individual, firm, copartnership, association of persons or corporation and shall include the plural as well as the singular of such term.

It shall be unlawful for any person, firm, copartnership, association of person, or corporations to enter into or carry on or engage in operating a recreation parlor without having first obtained a license therefor, as hereinafter provided, and the charge therefor and the issuance thereof, having been fully settled before said license shall be issued.

The annual charge for the licensing of any recreation parlor shall be the sum of one hundred dollars ($100.00). Licenses purchased after July 1 shall be charged at the rate of this sum.

No license issued by virtue of this Chapter shall authorize any person to carry on and operate a creation parlor within the City of Portageville, Missouri at more than one place of business at the same time, nor for a period of more than one (1) year.

Every license issued by virtue of any requirement or provision of this Chapter shall be signed by the City Clerk of Portageville, Missouri, who shall affix thereto the corporate seal of said City, and the City Collector shall countersign said license. No license shall be issued to any person until the amount prescribed therefor shall have been paid to the City Collector, and no license shall in any case be assigned to any other person. No license shall be issued to any person under age twenty-one (21). All licenses issued shall be issued for the time period of January 1 through December 31. Said license shall expire on December 31 annually whereby the same must be reissued upon proper application.

A license record shall be kept by the City Clerk, which shall show the name of the person, the amount of the license, and the expiration date thereof.

When properly issued and recorded the City Clerk shall deliver said licenses to the City Collector taking his/her receipt therefor and charging him/her with full amounts on the City books, whereupon the City Collector shall make prompt collections therefor.

All monies received by the City Collector as license fees and all other money collected under this Chapter shall be placed to the credit of the General Revenue fund.

It is hereby made a duty of every person receiving and having a license as herein provided, to keep said license at all times posted in full view in a conspicuous place at and in his/her place of business.

It shall be unlawful to operate a recreation parlor or game room in the City limits of Portageville before 7:00 A.M. and after 10:00 P.M. Monday through Saturday and before noon and after 7:00 P.M. on Sunday.

It shall be unlawful for any person under age eighteen (18) to smoke upon the premises of any recreation parlor or game room licensed hereunder.
