All City elections shall be conducted and held in conformance
with the provisions of Chapter 115, RSMo.
A.
A municipal election for the qualified voters of this City shall
be held on the first Tuesday after the first Monday in April of each
year.
B.
On the first Tuesday after the first Monday in April of 1969 and
every four (4) years thereafter, a municipal election of the qualified
voters of the City of Malden shall be held for the purpose of electing
a Mayor who shall hold his/her office for a term of four (4) years
and until his/her successor is elected and qualified.
C.
On the first Tuesday after the first Monday in April of odd-numbered
years, a municipal election of the qualified voters of the City of
Malden shall be held for the purpose of electing one (1) Council member
from each ward who shall hold his/her office for a term of two (2)
years and until his/her successor is elected and qualified.
D.
On the first Tuesday after the first Monday in April of even-numbered
years, a municipal election of the qualified voters of the City of
Malden shall be held for the purpose of electing one (1) Council member
from each ward who shall hold his/her office for a term of two (2)
years and until his/her successor is elected and qualified.

Any person who desires to become a candidate for an elective
City office at the general City election shall file with the City
Clerk, not prior to the hour of 8:00 A.M., on the 17th Tuesday prior
to, nor later than 5:00 P.M., on the 14th Tuesday prior to the next
City municipal election, a written declaration of his/her intent to
become a candidate at said election. The City Clerk shall keep a permanent
record of the names of the candidates, the offices for which they
seek election, and the date of their filing, and their names shall
appear on the ballots in that order.
A.
No
person shall qualify as a candidate for elective public office in
the State of Missouri who has been found guilty of or pled guilty
to a felony under the Federal laws of the United States of America
or to a felony under the laws of this State or an offense committed
in another state that would be considered a felony in this State.
B.
Any
person who files as a candidate for election to a public office shall
be disqualified from participation in the election for which the candidate
has filed if such person is delinquent in the payment of any State
income taxes, personal property taxes, municipal taxes, real property
taxes on the place of residence, as stated on the declaration of candidacy,
or if the person is a past or present corporate officer of any fee
office that owes any taxes to the State.
C.
Each
potential candidate for election to a public office shall file an
affidavit with the Department of Revenue and include a copy of the
affidavit with the declaration of candidacy required under Section
115.349, RSMo. Such affidavit shall be in substantially the form as
set out in Section 115.306, RSMo.
D.
Upon
receipt of a complaint alleging a delinquency of the candidate in
the filing or payment of any State income taxes, personal property
taxes, municipal taxes, real property taxes on the place of residence,
as stated on the declaration of candidacy, or if the person is a past
or present corporate officer of any fee office that owes any taxes
to the State, the Department of Revenue shall investigate such potential
candidate to verify the claim contained in the complaint. If the Department
of Revenue finds a positive affirmation to be false, the Department
shall contact the Secretary of State, or the election official who
accepted such candidate's declaration of candidacy, and the potential
candidate. The Department shall notify the candidate of the outstanding
tax owed and give the candidate thirty (30) days to remit any such
outstanding taxes owed which are not the subject of dispute between
the Department and the candidate. If the candidate fails to remit
such amounts in full within thirty (30) days, the candidate shall
be disqualified from participating in the current election and barred
from refiling for an entire election cycle even if the individual
pays all of the outstanding taxes that were the subject of the complaint.
The City Clerk shall, on or before the 17th Tuesday prior to
any election at which City offices are to be filled by said election,
notify the general public of the opening filing date, the office or
offices to be filled, the proper place for filing, and the closing
filing date of the election. Such notification may be accomplished
by legal notice published in at least one (1) newspaper of general
circulation in the City.
In City elections, the City Clerk shall notify the County Clerk
prior to 5:00 P.M. on the 10th Tuesday prior to any City election
except as noted in Section 115.125, RSMo. The notice shall be in writing,
shall specify that the City Council is calling the election, the purpose
of the election, the date of the election, and shall include a certified
copy of the legal notice to be published including the sample ballot.
The notice and any other information required by Section 115.125,
RSMo., may, with the prior notification to the election authority
receiving the notice, be accepted by facsimile transmission prior
to 5:00 P.M. on the 10th Tuesday prior to the election, provided that
the original copy of the notice and a certified copy of the legal
notice to be published shall be received in the office of the election
authority within three (3) business days from the date of the facsimile
transmission.

The City is hereby divided into four (4) wards and said wards are
described as follows:
1.
Ward One. All of that part of the City of Malden lying north
and west of a line beginning at the intersection of the east line
of the Malden City limits and the center line of East Howard Street
extended; run thence west of the center line of Howard Street to the
center line of East Park Street; thence west on the center line of
East Park Street to the Union Pacific Railroad right-of-way, thence
in a northerly direction along said railroad to the north City limit
line; thence 1,500 feet east from center line of County Road 118;
then south 1,150 feet to the Highway 25 right-of-way; thence 336 feet
southeast down Highway 25 right-of-way; thence east 1,254 feet; thence
4,100 feet south to Broadwater line; thence east 260 feet; thence
south 4,300 feet to Howard Street which is also POB.
2.
Ward Two. All of that part of the City of Malden lying north
and west of a line beginning at the intersection of the east line
of the Malden City limits and the center line of East Howard Street
extended; thence run west to the center line on East Howard Street
to the center line of North Edwards Street; thence run north to the
center line of North Edwards to the center line of East Park Street;
thence along the center of East Park Street; run thence west to the
center line of Madison Street; thence along the center line of Madison
Street to the intersection of Madison Street and the Union Pacific
Railway; thence in a southwesterly direction along said railroad to
the City limits sign, thence center of Union Pacific Railway South
to center of Indiana 1,202 feet; then east from center of Indiana
to center of S. Douglass 1,376 feet; thence south from center of S.
Douglass to center of Arthur Street 1,742 feet; thence east from Arthur
Street to center of South Madison Street 1,318 feet; thence south
center of N. Madison to center of intersection of Business 25 and
Highway 25 1,900 feet; thence north from center of intersection of
Business 25 and Highway 25 to center of East Howard 9,202 feet. Including
the entirety of Compress Property consisting of 21.5 acres.
Legal Description of Compress Property. Starting at the center
of West Ollie Street and center of South Douglass St. heading south
270 feet; thence east 23 feet to POB; thence east 730 feet; thence
south 1,270 feet; thence west 730 feet to the east right-of-way of
South Douglass; thence north 1,270 feet to POB.
3.
Ward Three. All that part of the City of Malden lying within
the area described as beginning at the intersection of Union Pacific
Railroad and the west line of the City limits of Malden, and run thence
in a northeasterly direction 3,714 feet along the said railroad to
the center line of Madison Street; thence north 1,785 feet to the
center line of Park St.; thence east along the center line 630 feet
of Park St. to the Railroad right-of-way; thence northerly to the
center line of Broadwater Road 4,229 feet; thence west 2,575 feet
to the center line of Alberta Street; thence south 1,311 feet to the
southern side of Burkhart St.; thence west 567 feet; thence south
1,334 feet to the center line of Highway J; thence west 258 feet;
thence south 1,293 feet; thence east 284 feet; thence south 816 feet;
thence east 1,336 feet; thence south 574 feet; thence west 1,337 feet;
thence south 1,287 feet; thence east along the center line of Highway
AB 1,198 feet; thence south 1,161 feet to POB.
4.
Ward Four. All that part of the City of Malden lying north and
west of a line beginning at the intersection of the Union Pacific
Railroad and the north line of the Malden City limits; thence run
south along said Railroad 2,659 feet; thence east 540 feet; thence
south 10,662 feet to center of Broadwater Road; thence 4,425 feet
west on center line of Broadwater Road, thence 1,323 feet north; thence
1,771 feet east; thence 3,990 feet north; thence 9,351 west down the
center line of County Road 118; thence 10,524 feet north; thence 12,036
feet east to North Douglass which is POB.
