Except for unusual or unforeseen emergencies, parks shall be open to the public every day of the year between the hours of 5:00 a.m. and 10:00 p.m. local time, unless otherwise designated by the Town Board. It shall be unlawful for any person or persons, other than Town personnel conducting Town business therein, to occupy or be present in said park during any hours in which the park is not open to the public, unless approved by resolution of the Town Board or by written approval of the Town Recreation Director.
Any law enforcement agency having authority to act within the Town will have authority enforce the provisions of this chapter and any other local law relating to the use of said park.
A. 
Upon conviction, a violation of this chapter shall be deemed an offense and shall be punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or both.
B. 
In addition to the fines and penalty set forth above, upon a second or subsequent conviction for a violation of this chapter, the person or persons so convicted may be permanently barred and excluded from the use of any facilities covered by this chapter by an order of the Town Justice.
