As used within this Article, the following words shall have the listed definitions:
CURB
A stone or concrete edging to a street or path.
GUTTER
A channel along the side of a street for directing and carrying rainwater.
MAJOR STREET REPAIR
A street construction project where more than fifty percent (50%) of the paving surface and/or paving surface base is replaced, within the area being repaired, within a two-year period. This includes, but is not limited to, full-depth reconstruction of the street and side-to-side pavement milling and resurfacing.
NEW CONSTRUCTION
A construction project that creates a street or roadway where one did not previously exist or a construction project that fully improves a previously deteriorated driving surface, including those made of gravel or rock, to a new, paved surface.

A. 
All curb and gutter shall be constructed under the supervision of the City Engineer or Public Works Director.
B. 
All curb and gutter shall be constructed according to the current design standards as may be modified from time to time by the Board of Aldermen.

A. 
All new streets or roadways shall be installed with curb and gutter.
B. 
All curb and gutter installed along any new street or roadway shall be installed by the property owner or his/her designee.
C. 
All costs associated with the installation of the new curb and gutter, including but not limited to all labor, materials, and permit costs, shall be borne by the property owner.

A. 
All curb and gutter installed or replaced as part of a major street repair project shall be installed by the City of Owensville or its designee.
B. 
Those portions of curb and gutter to be replaced or repaired as part of the major street repair project shall be determined by the City Engineer or Public Works Director.
C. 
All costs associated with the installation or replacement of the curb and gutter, including but not limited to all labor and materials costs, shall be borne by the City of Owensville.

A. 
Any property owner whose property abuts a City street that is not scheduled to be included in a major street repair project within the next two (2) years may apply to replace their existing curb and gutter as part of this cost share program.
B. 
To be considered for the cost share program, the property owner will be required to provide information detailing the location and condition of the existing curb and gutter and indicating why the property owner is requesting said curb and gutter to be replaced.
C. 
As part of the cost share program, the City's Public Works Department agrees to perform the following actions:
1. 
Excavate and remove the existing curb and gutter.
2. 
Provide granular fill to serve as a base for the new curb and gutter.
3. 
Patch the street and connect the street to the new curb and gutter upon completion of the installation of the new curb and gutter.
D. 
As part of the cost share program, the property owner, or his/her designee, will be required to perform the following actions:
1. 
Obtain all necessary permits.
2. 
Hire a licensed contractor to grade the surface for the new curb and gutter, pour the new curb and gutter, and backfill any remaining holes or vacancies.
3. 
Pay for any additional costs which may be associated with the project not expressly listed herein.
E. 
Those portions of curb and gutter to be included in any particular cost share program shall be determined by the City Engineer or Public Works Director. Factors used to determine if and when a particular portion of curb and gutter will be replaced in any particular cost share program, include, but shall not be limited to, the following:
1. 
Available funding.
2. 
Traffic volume.
3. 
Safety concerns and hazards caused by the damaged curb or gutter.
4. 
Aesthetic improvements desired by the property owner.
5. 
City of Owensville employee availability and workload.

A. 
The City's involvement and/or enforcement of any section or project as described within this Article shall be made under the City's sole and absolute discretion.
B. 
The City's participation in any given project shall not guarantee future participation in similar projects.

This Article shall apply only to public streets within the City.
