The following activities will be exempted from the requirements of this chapter with concurrence of the Zoning Officer who will determine whether the exemptions cited herein are applicable. The decision of the Zoning Officer may be appealed to the Borough Council after review by the Planning Commission.
A. 
The conversion of an existing single-family detached dwelling or single-family semi-detached dwelling into not more than three residential units unless such units are intended to be a condominium.
B. 
The addition of an accessory building, including farm buildings, on a lot or lots subordinate to an existing principal building.
C. 
The addition or conversion of buildings or rides within the confines of an amusement park. This exclusion will not apply to newly acquired tracts or parcels being added to an existing amusement park.
D. 
The division of land by lease for agricultural purposes into parcels of more than 10 acres that do not involve any new street, right-of-way or residential dwelling. Upon the request of the property owner and upon receipt of a signed statement or letter from the property owner and leasee stating that the lands to be leased meet the preceding conditions, the Borough will forward a statement of exemption to the concerned parties.
The following activities may be exempted from the requirements of this chapter by Borough Council upon recommendation by the Planning Commission and Borough Engineer:
A. 
The enlargement of a building by an addition of no more than 15% of the building's existing square footage provided the following conditions are met:
(1) 
The addition does not exceed 500 square feet and is not separated from the existing structure.
(2) 
There is no change to any street or public way.
(3) 
There is no interference or substantial change to drainage or the flow of water.
(4) 
The Zoning Officer determines that the enlarged building would be in compliance with all zoning requirements.
(5) 
The Borough Engineer determines that the enlarged building would be in compliance with all land development requirements.
B. 
The replacement of a structure that is necessitated by unpreventable acts of God (including but not limited to fire, flood and storm damage) and that meets the following conditions:
(1) 
The structure has been deemed unoccupiable by the Code Enforcement Officer.
(2) 
Repair of the damage to the existing structure is significantly more costly than the structure's replacement.
(3) 
The new structure will be relatively the same size.
(4) 
The layout and lot access are relatively unchanged from what had been approved under a previous land development application.
(5) 
The Zoning Officer confirms that the proposal meets all applicable land use regulations.
(6) 
The applicant provides written confirmation that the proposal meets all applicable state regulations.
