This article shall be known as and may be cited as the "Pine Grove Traffic Control Ordinance."
The intent of this article is to exercise the authority, granted by the General Assembly of the Commonwealth of Pennsylvania Act of June 17, 1976, P.L. 162, No. 81, as amended (the Vehicle Code; Title 75 of Pennsylvania Consolidated Statutes) in an effort to promote the general health, welfare, and safety of the Borough of Pine Grove and to provide for the uniform administration of Motor Vehicle Control within the Borough of Pine Grove.
This article shall apply uniformly to all persons and all motor vehicles while operated or parked within the Borough of Pine Grove or any property owned by the Borough of Pine Grove and over which it exercises control.
A. 
Unless specifically defined below, words or phrases used herein shall be interpreted so as to give them the same meaning as they have in common usage and so as to give this article its most reasonable application consistent with the intent herein expressed.
B. 
Except as specifically provided, words and phrases herein shall have the definitions provided in the Vehicle Code; Act of June 17, 1976, P.L. 162, No. 81, as amended; Title 75 of Pennsylvania Consolidated Statutes.
C. 
The word "shall" is always mandatory and not merely directory.
D. 
Words used in the present tense include the future and past, words in the plural number include the singular, words in the singular number include words in the plural, and words either in the feminine, masculine or neuter shall include words of the other two genders.
E. 
The time, whenever specified, shall be that which is being generally observed within the Borough, whether it be Eastern Standard Time or Eastern Daylight Time.
F. 
Holidays are the following days:
(1) 
New Year's Day.
(2) 
Memorial Day.
(3) 
Independence Day.
(4) 
Labor Day.
(5) 
Thanksgiving Day.
(6) 
Christmas Day.
All provisions of the Vehicle Code (Act of June 17, 1976, P.L. 162, No. 81, as amended; Title 75 of the Pennsylvania Consolidated Statutes) shall apply within the Borough of Pine Grove, on all streets and highways therein; except, the specific provisions of this article shall be read to expand the provisions of the Vehicle Code. All provisions herein are to be construed whenever possible, to be consistent with the provisions of the Vehicle Code; and all provisions herein shall be construed as expanded, clarified, and augmented by applicable provisions of the Vehicle Code.
A. 
The speed limit on all streets and highways within the Borough of Pine Grove, except as otherwise provided for below in this section, shall be 25 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established.
B. 
The speed limit on the following sections of streets and highways within the Borough of Pine Grove shall be 30 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established:
(1) 
East Pottsville Street between the Swatara Creek bridge and South Tulpehocken Street.
C. 
The speed limit on the following sections of streets and highways within the Borough of Pine Grove shall be 35 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established:
(1) 
North Tulpehocken Street for its entire length (from the Borough line until it becomes South Tulpehocken Street just Northerly of the intersection of South Tulpehocken Street with Pottsville Streets).
(2) 
South Tulpehocken Street from the Borough line to its intersection with Maple Street.
D. 
The speed limit on the following sections of streets and highways within the Borough of Pine Grove shall be 40 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established:
(1) 
East Pottsville Street between the Borough line and the Swatara Creek bridge.
(2) 
Outwood Street between the Borough line and North Tulpehocken Street.

E. 
The speed limit on all streets and roads across property owned by the Borough of Pine Grove, which are not streets and highways within the Borough, shall be 15 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established.
F. 
The following school zones are hereby established on portions of certain streets and highways within the Borough for which a speed limit of 15 miles per hour is provided; and it shall be unlawful for any person to operate a vehicle in excess of such speed limit within such school zones at times when such designation as a school zone is effective:

American Legion Boulevard between East Pottsville Street and First Street.
(2) 
East Pottsville Street between the Borough line and the Swatara Creek Bridge.
(3) 
High Street between Daubert Street and South Tulpehocken Street.

School Street between East Pottsville Street and Pine Hill Drive.
(5) 
South Tulpehocken Street between East Mill Street and Union Street.
(6) 
Walter Street between Leonard Street and West Wood Street.
G. 
The speed limits on the following sections of streets and highways within the Borough of Pine Grove shall be 15 miles per hour; and it shall be unlawful for any person to operate a vehicle in excess of the speed limit hereby established:

The following streets and highways within the Borough are hereby established as through highways; and the operator of every vehicle upon approaching any such highway at any intersection thereof, except where such intersections may be governed by traffic-control signal or as may otherwise be provided, shall come to a full stop within a reasonable distance before entering such intersection:

A. 
The following intersections located within the Borough of Pine Grove are hereby declared as stop intersections; and all vehicles approaching on the first named street, traveling in the direction indicated, shall come to a full stop within a reasonable distance before entering the intersection of such first named street with the second named street:

C. 
No turn shall be permitted by vehicular traffic facing a steady red signal; only vehicular traffic facing a steady green signal shall be permitted to proceed.

B. 
The term "snow storm" shall mean any continuous snowfall resulting in an accumulation of snow three inches or more in depth.
C. 
Upon the occurrence of a snow storm, all vehicles parked upon or along a snow route shall be promptly removed from the snow route by the owners or custodians of such vehicles and no vehicles shall thereafter be parked on the snow route until after the snow has been removed therefrom.
A. 
The term "disabled vehicle" shall mean both:
(1) 
Any vehicle incapable of movement under its own power or incapable of movement because of mechanical defects; and also
(2) 
Any vehicle which does not bear current registration plates or which does not have a certificate of inspection issued by an official inspection station.
B. 
It shall be unlawful for any person to park or permit to be parked upon or along any street or highway within the Borough any disabled vehicle.

When any vehicle is found parked and unoccupied upon or any along any street or highway within the Borough or on any street or road across property owned by the Borough, it may be presumed that such vehicle was parked by its owner. The burden shall be placed upon the owner to prove by clear and convincing evidence that he did not park his vehicle or permit his vehicle to be parked in the location where same is found; and, in the absence of such evidence, it shall be found that the owner parked his vehicle and left it where found unoccupied.

Parking meters installed in the parking meter zones established by § 173-15C of this article shall be placed upon curb or sidewalk, and immediately adjacent to the individual parking spaces described in § 173-20 of this article. Each parking meter shall be placed or set so as to show that the parking space adjacent to that meter is or is not legally occupied. Each parking meter installed shall indicate by a proper legend the legal parking time established by the Borough and when the adjacent space is occupied by a vehicle, the parking meter shall indicate on and by its dial and pointer the duration of the period of legal parking and, on the expiration of that said period, shall indicate illegal parking or over-parking.

A. 
It shall be unlawful for the owner or operator of any vehicle to park for a longer period than the maximum time indicated on the dial of the parking meter for the space occupied between the hours of 9:00 a.m. and 6:00 p.m., except on Sundays and Holidays; and failure to operate a meter adjacent to a parking space while occupying said space which results in parking a vehicle overtime shall constitute a violation.
B. 
Parking meters, when properly operated, shall be so adjusted that $0.05, $0.10 and $0.25 coins may be deposited at any time throughout the maximum range of the meter:

(1) 
Each five-cent coin permitting the vehicle to be parked for a period of 12 minutes;
(2) 
Each ten-cent coin permitting the vehicle to be parked for a period of 24 minutes;
(3) 
Each $0.25 coin permitting the vehicle to be parked for a period of 60 minutes (one hour).

A. 
Handicapped parking meters shall be placed in certain areas currently designated for handicapped parking at specific addresses, as follows:
(1) 
By 56 South Tulpehocken Street, in front of 127 South Tulpehocken Street.
(2) 
By 126 South Tulpehocken Street.
(3) 
By 56 South Tulpehocken Street.
B. 
The requirements for those parking at the handicapped parking meters shall be the same as for those parking at metered parking pursuant to this chapter. Those who park at the handicapped parking meters must satisfy the criteria as a handicapped person or be subject to additional fines and penalties pursuant to the Pennsylvania Motor Vehicle Code.

A. 
Any Pine Grove Borough resident may apply for a yearly handicapped parking meter permit by filing a written application with the Borough office that, if approved, will allow the resident, with proper showing of the permit, the ability to park at a handicapped parking meter located within the Borough without paying the required meter fee.
B. 
Any Borough resident interested in obtaining a handicapped parking meter permit shall complete a written application at the Borough office and provide certification that the resident meets the criteria for handicapped parking. The requirements for those residents applying for the handicapped parking meter permits shall be the same as for those applying for handicapped parking permits. The application must be approved by the Pine Grove Borough Chief of Police. The yearly fee for the handicapped parking meter permit shall be $108. The permit must be renewed on annual basis by filing a renewal application with the Borough office and payment of the yearly fee. This fee may be increased by Borough Council by resolution only.
C. 
Any person violating this section or any other ordinance dealing with handicapped parking shall be subject to additional fines and penalties pursuant to the Pennsylvania Motor Vehicle Code[1] and duly enacted Pine Grove Borough ordinances.

It shall be unlawful to park any vehicle across any line or marking designating the division line between parking spaces.
A. 
It shall be unlawful to deposit, or cause to be deposited, in any parking meter a slug, devise or substitute for a coin of the United States of America.
B. 
It shall be unlawful for any person to deface, damage, open, destroy, impair the usefulness of, or in any other manner tamper with any parking meter installed within the Borough of Pine Grove.
A. 
All vehicles owned by the Borough of Pine Grove when being operated while on duly authorized business of the Borough shall be exempt from all provisions of § 173-19, hereof.
B. 
Any vehicle occupying a metered parking space adjacent to a meter which is not in proper operation due to no fault of the operator and owner shall be exempt from all provisions of § 173-19, hereof; however, this exemption shall not apply where the malfunction of the meter resulted from a violation of § 173-21, hereof, by the owner or operator.
C. 
Any vehicle occupying a metered parking space adjacent to a meter which is covered or marked by an authorized device properly issued for an appropriate fee by an authorized Borough Official shall be exempt from all provisions of § 173-19, hereof.
Any person violating any provision of the Vehicle Code (Act of June 17, 1976, P.L. 162, No. 81, as amended; Title 75 of the Pennsylvania Consolidated Statutes) by or through § 173-5, hereof, shall be guilty of such offense and shall, upon conviction, be sentenced as provided in the Vehicle Code.
A. 
All fines provided for in this section shall be in addition to costs.
B. 
Any person violating § 173-6, hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit. Additionally, violation of § 173-6, hereof, shall also be deemed in violation of the Vehicle Code, in existence at the time of the violation, and appropriate additional fines and penalties applicable thereunder shall be applicable, including specifically assignment of points, as appropriate, under the point system for driver education and control. (See 75 Pa.C.S.A. § 1535.)
C. 
Any person violating § 173-7, 173-8, 173-9, 173-10, 173-11 or 173-13 hereof is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $25. Additionally, violation of the sections aforementioned in this subsection of § 173-24 shall also be deemed in violation of the Vehicle Code, in existence at the time of the violation, and appropriate additional fines and penalties applicable thereunder shall be applicable; including specifically assignment of points, as appropriate, under the point system for drive education and control. (See 75 Pa.C.S.A. § 1535.)
D. 
Any person violating § 173-12, hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $15. Any person who is the owner or operator of a truck, as defined for the purpose of § 173-12, hereof, where the maximum gross weight is in excess of 13,000 pounds shall pay an additional fine of $1 per each 2,000 pounds in excess of 13,000 pounds.
A. 
All fines provided for in this section shall be in addition to costs.
B. 
Any person violating § 173-14 or § 173-15, hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $25. Additionally, violation of § 173-14 or § 173-15, hereof, shall also be deemed in violation of the Vehicle Code, in existence at the time of the violation, and appropriate additional fines and penalties applicable thereunder shall be applicable.

(1) 
Any person violating § 173-16 or 173-17, hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $15.
(2) 
Any vehicle parked in violation of § 173-16 or 173-17, hereof, is declared to constitute a nuisance and obstruction in the streets and highways of the Borough of Pine Grove and, notwithstanding the penal provisions of § 173-25C(1), hereof, shall be removable by the Borough from the streets and highways; and any person in violation of § 173-15 or 173-17, hereof, where such vehicle in violation was removed by the Borough shall be liable to pay an additional fine not to exceed $50 for the cost of such removal by the Borough.

A. 
It shall be the duty of the Police Officers and Parking Enforcement Personnel of the Borough, acting in accordance with the directions of the Chief of Police, to report:
(1) 
The number of each parking meter that indicates that a vehicle occupying the adjacent parking space is, or has been, parked in violation of any provision of this article.
(2) 
The date and hour of the violation.
(3) 
The license number of the vehicle.
(4) 
Any other facts, the knowledge of which is necessary for a thorough understanding of the circumstances attending the violation.
B. 
The Police Officer or other person making the report shall also place on or attach to the vehicle a notice to the owner or the driver of the vehicle that the vehicle was parked in violation of this article, and instructing the owner or driver that if he will report to the office of the Pine Grove Police Department and pay, for the use of the Borough, the sum of $15, or will place the sum of $15 enclosed within the envelope provided within 10 days, that act will save on the violator from prosecution from payment of the fine prescribed in § 173-26C of this article.
C. 
Any person who violates any provision of this part of this article, with the exception of § 173-21, and who fails to pay the fine set forth in § 173-26B, shall be cited within 10 days of the violation and, upon conviction, be sentenced to pay a fine not less than $15 nor more than $50 and costs.
D. 
Any person who violates any provision of § 173-21 of this article, upon conviction, shall be sentenced to pay a fine of not more than $1,000 in costs and, in default of payment of fine and costs, to imprisonment for not more than 30 days.
A. 
Any person sentenced to pay a fine under § 173-23, 173-24, or 173-25, hereof, who fails to pay said fine as required by law may be prosecuted further as provided for under the Vehicle Code.
B. 
In addition to, or as an alternative to, the provision of § 173-27A hereof, any person sentenced to pay a fine under § 173-24, 173-25, or 173-26, hereof, who fails to pay said fine within 30 days of sentencing unless an appropriate appeal is taken which stays sentencing, is guilty of an additional violation of this article and shall, upon conviction, be sentenced to undergo imprisonment in the Schuylkill County prison for a period not to exceed 15 days, or, alternatively, to pay the original fine, original costs of suit, additional costs of suit for enforcement of this provision, and an additional fine of $10.
All future traffic and all future parking regulations or any other future regulations dealing with the subject matter contained herein, when such is of a permanent nature and in addition to the Vehicle Code as it is now or may be amended, shall be enacted as an ordinance, or as an amendment to this article, of the Borough of Pine Grove.
A. 
The Mayor shall have the following power to regulate traffic and parking temporarily and in times of emergency:
(1) 
In the case of flood, fire, storm or other emergency, to establish temporary traffic and parking regulations.
(2) 
In the case of emergency or to facilitate public works, or in the case of the conduct of processions, parades or public events, to restrict or prohibit traffic or parking in limited areas for periods of not more than 72 hours.
B. 
In special or emergency situations, provisions hereof may be temporarily suspended by the Chief of Police, or the acting head of the police, and he may prescribe temporarily such other rules and regulations as traffic conditions may require; provided, however, that no such action shall be for a period of greater than 12 hours unless confirmed within that time by the Mayor.

The Police Officers of the Borough are hereby specifically given authority to enforce the provisions of this article.

A. 
Regulations.
(1) 
Except as provided in Subsection A(3), (4) and (5) of this section, all vehicles are prohibited from traveling on all Borough streets carrying in excess of 12 tons maximum gross weight.
(2) 
Except as provided in Subsection A(3), (4) and (5) of this section, all vehicles making non-local deliveries are prohibited from traveling on all Borough streets.
(3) 
The above prohibitions shall not apply to SR 125, SR 443 and SR 895.
(4) 
The above prohibitions shall not apply when a vehicle is making a delivery on, or has its origin or destination located within an area on, a prohibited street; and the prohibitions shall not apply to service trucks.
(5) 
The above prohibitions shall not apply to all vehicles owned by the Borough of Pine Grove when being operated on duly authorized business of the Borough.
B. 
Penalties pursuant to violations of Subsection A.
(1) 
All fines provided for in this section shall be in addition to cost.
(2) 
Any person violating Subsection A(1) hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $35 and shall pay an additional fine of $1 per each 2,000 pounds in excess of 12 tons.
(3) 
Any person violating Subsection A(2) hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay of fine of $35.

A. 
Mandatory requirements.
(1) 
It shall be mandatory for contractor(s) to post a bond for the following procedures:
(a) 
The excavation and the replacement of streets; and
(b) 
The excavation and the replacement of sidewalks; and
(c) 
The removal and replacement of trees (if the number of trees exceed the number determined allowable by the Tree Commission).
(2) 
The amount of bond in all cases pursuant to Subsection A shall be equal to the replacement value of all work to be performed by contractor(s).
B. 
Penalties pursuant to violations of Subsection A.
(1) 
All fines provided for in this section shall be in addition to costs.
(2) 
Any person violating Subsection A, hereof, is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $50.

A. 
Requirements.
(1) 
The yellow lines on the Borough streets shall be extended as follows:
(a) 
The yellow line that runs on South Tulpehocken Street shall be extended from the Wood Street Intersection to the end of the Kurt Wessner property; approximately 376 feet.
(b) 
The yellow line that runs on East Pottsville Street from East to West shall be extended from its existing location at the bridge on SR 443 to the Intersection at Mill Race and Pottsville Streets.
(c) 
The yellow line that runs from West to East on the southeast corner of Maple and Peach Streets shall be extended approximately 15 feet.

Any person, firm or corporation who or which violates any of the provisions of this article or fails to comply with the provisions of this article shall, as a first offense, receive a warning by the Pine Grove Borough Police Department. Any person, firm or corporation who or which violates any of the provisions of this article or fails to comply with the provisions of this article shall, as a second offense, upon conviction thereof before a Magisterial District Judge, be fined not more than $25, plus costs of prosecution, and in default of payment of such fines and costs be imprisoned for not more than 30 days. Any person, firm or corporation who or which violates any of the provisions of this article or fails to comply with the provisions of this article shall, as a third or subsequent offense, upon conviction thereof before a Magisterial District Judge, be fined not more than $50, plus costs of prosecution, and in default of payment of such fines and costs be imprisoned for not more than 30 days.

Upon the failure of any person, persons, firm or corporation to comply with the provisions of this article, the Borough shall forthwith cause said snow or ice to be removed from the full width of the paved surface of said sidewalk and the owner or occupier so offending shall be liable for the costs thereof plus the penalty of 10% for the use of the Borough, said costs and penalties be recoverable before a Magisterial District Judge as such debts are by law recoverable, provided that such costs and penalties shall be collected in addition to any fine or imprisonment imposed under the provisions of § 173-30.6 of this article.

At any time Borough Council desires to amend the amount of violations and penalties, it may do so by resolution of Pine Grove Borough Council and without the requirement of adoption of another ordinance.
