There is established within the Village of Wild Rose a Police
Department consisting of a Chief of Police and such officers as determined
by the Village Board. The Chief of Police shall receive advice from
the Village Board, the Police Committee, and the Board of Police Commissioners,
but have ultimate supervisory authority over the Department. The Chief
of Police shall be under the immediate control of the Chairman of
the Police Committee.
All members of the Police Department, including the Chief, shall
be appointed, promoted, suspended, dismissed or reduced in rank pursuant
to Wisconsin Statutes and upon recommendation of the Village Police
Committee and Board of Police Commissioners.

General power. Subject to the provisions of this chapter and the
lawful orders of the Board of Police Commissioners, the Village Board,
and the Village President, the Chief of Police shall be in charge
of the Police Department. The Chief of Police shall be the Marshal
ex officio upon executing and filing his/her official bond as such
Marshal pursuant to ยงย 61.28, Wis. Stats. All members of
the Police Department shall be officers of the Municipal Court.

Duties. The Chief of Police, subject to the provisions of this chapter,
shall cause the public peace to be preserved and see that all ordinances
of the Village and the laws of the State of Wisconsin are enforced
and obeyed; that the rules, regulations, and procedures relative to
the function of the Police Department are obeyed. Whenever any violation
of the ordinance or laws shall come to his/her attention, he/she shall
cause requisite complaints to be made and see that the offender or
offenders are prosecuted. He/she shall be responsible for the efficient
and general good conduct of his/her Department and shall be empowered
to make regulations to accomplish efficiency.

Deposit of penalties and costs. When a person has been arrested for
violating a Village ordinance, the Chief of Police may require that
individual to post bond. The amount of the bond shall be equal to
the whole amount of the penalty and costs prescribed for such violation,
and may release such person from arrest until the subsequent convening
of the Court. The bond monies shall immediately be deposited with
the Municipal Court Clerk, or the Clerk of Circuit Court, for Waushara
County, and shall not be held by the Chief of Police or any Village
police officer. No member of the Police Department shall furnish bail
for any person arrested.

Regulations of department. The Chief of Police shall regulate and
assign the hours and duties for each of the members of the Department.

Hours of duty. The normal hours of duty and vacations for the Chief
of Police shall be as prescribed by the Village Board. He/she shall
be on duty during such hours as are necessary to enable him/her to
properly supervise and participate in the work of the Department to
the satisfaction of the Village Board. Except in case of an emergency,
or in situations covered under ยงย 175.40(2) and (3), Wis.
Stats., the Chief of Police is prohibited from leaving Waushara County
during his on-duty hours.

Records. The Chief of Police shall ensure that up-to-date records
are maintained. These records shall include daily activity logs for
all shifts, dispatch records, citation and/or arrest documents, and
individual assist/response records. Copies of citations and other
support documentation subject to judicial action shall be given to
the Municipal Court Judge or Municipal Court Clerk in a timely manner.

Reports. The Chief of Police shall prepare a consolidated monthly
report and deliver same to the Village Clerk three days prior to the
regular monthly Village Board meeting. Special reports shall be prepared
and submitted to the Village President upon request.
In addition to the Chief of Police, there shall be such other
Village police officers as the Village Board shall authorize and Board
of Police Commissioners shall select.
Salaries of the Chief of Police and all other members of the
Department shall be as determined by the Village Board from time to
time.
The hours of duty, overtime pay and vacations shall be as prescribed
by the Village Board.
Each Village police officer shall furnish his/her own uniform
and shall receive such uniform allowance as the Village Board shall
prescribe. No Village police officer shall have a vested right in
the uniform allowance, and in the event he/she shall terminate his/her
employment with the Village as a Village police officer prior to any
time herein before set for payment of the uniform allowance, he/she
shall not receive any pro rata payment.
The Village shall furnish ammunition and badges to the Chief
of Police and subordinates and such equipment shall remain the property
of the Village under the care and charge of the Chief of Police and
the Public Safety Commission.

All examinations for appointment to the Police Department shall
be carried on according to ยงย 62.13(4)(c), (d), and subject
to ยงยงย 111.321, 111.322, and 111.325, Wis. Stats., under
the supervision of the Chief of Police and the Police Committee. The
Police Committee shall certify to the Board of Police Commissioners
the three most qualified applicants (fewer than three permitted if
fewer than three qualify). The Board of Police Commissioners shall
make an appointment from the three applicants who are so certified,
and forward their appointment to the Village Board for confirmation.
The Chief of Police and/or Board of Police Commissioners makes an
appointment from an eligible list of all qualified applicants in accordance
with ยงย 62.13(4), Wis. Stats., or may request that search
deadlines be extended and that the process of examining applicants
be continued.
Whenever practicable, members of the Police Department shall
be residents of the Village of Wild Rose.
The Chief of Police may make such further rules, regulations
and policies for the government of the Police Department as he/she
may deem necessary, provided such rules and regulations shall be consistent
with the laws of the state or Village ordinances, and any collective
bargaining or labor contract which may be in effect.
Any member of the Police Department may be suspended for a period
of 30 days, or dismissed by the Chief of Police during his/her first
year of service. The Chief of Police may also be suspended or dismissed
during his/her first year of service by a two-thirds vote of the Village
Board. The Police Committee shall conduct a thorough review of the
circumstances prior to any disciplinary being taken during the probationary
period of any Village police officer.
The Village President and each Trustee shall be officers of
the peace and may suppress, in a summary manner, any riot or disorderly
conduct in the streets or public places of the Village, and may command
assistance of all persons under the same penalty for disobedience
provided in ยงย 61.31, Wis. Stats.
It shall be the duty of all persons in the Village, when called upon by any Village police officer or peace officer, to promptly aid and assist him/her in the execution of his/her duties, and whoever shall neglect or refuse to give such aid or assistance shall be subject to the general penalty as provided in Chapter 1-1 of this Code.
