There is hereby imposed upon the owners of and dealers in motor vehicles, residing or doing business in the City of Marceline, a motor vehicle license fee upon motor vehicles owned by them and operated within the City limits of Marceline. It shall hereafter be unlawful to operate or park upon any public right-of-way, or within fifteen (15) feet thereof, within the City unless said motor vehicle license fee has been paid as hereinafter provided.

"Owner," as used herein, is any person, firm, corporation or association who holds the legal title to a vehicle or in the event a vehicle is the subject of an agreement for the conventional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this Article.

No license fee imposed herein shall be collected from a resident owner of the City for any motor vehicle used exclusively outside the City of Marceline.

A. 
The owner of any vehicle for which a license is required shall pay a license fee as follows:
1. 
Passenger cars: five dollars ($5.00).
2. 
Trucks: five dollars ($5.00).
3. 
Motorcycles: two dollars ($2.00).

The license hereby required shall be issued for the period from January 1 of each year through December 31 of that year.

The license fee required under this Article shall be billed by the City on the bills issued for personal property taxes for the City of Marceline and shall be collected with and in the same manner as personal property tax as provided by State Statutes.

Any person operating or parking a motor vehicle, as herein provided, after January 1 without a City motor vehicle license for that year shall be in violation of this Article. Such violation shall be an ordinance violation and punishable as provided in Section 100.230 of this Code.

The term "motor vehicles" shall include all vehicles operated by any power other than muscular, except traction engines, road graders, fire engines or Police patrol wagons.

No person shall be eligible to purchase a City motor vehicle license who shall be delinquent in the payment of any tax, license, bill or account owing to the City of Marceline and such license shall not be issued by the City Clerk unless and until such tax, license, bill or account is paid in full.

The proceeds derived from the registration and license fees herein provided shall be used to defray the expense incident to the regulation and control of motor vehicles and vehicle traffic in the City of Marceline and any and all funds remaining hereafter shall be expended for the repair and improvements of streets and alleys in the City of Marceline.

Any duly licensed automobile dealer shall pay the same fee required for passenger automobile licenses as above provided. Such dealer's license may be transferred to any vehicle owned by the dealer to which such license is issued, provided that it shall be unlawful for any dealer to use or permit to be used any City dealer's license upon any vehicle not owned by such dealer and further provided that such dealer's vehicle license shall be used only upon a vehicle which the dealer holds for sale in the usual course of trade. Each dealer shall be required to purchase the same number of City dealer's vehicle license as such dealer shall hold of State vehicle dealer's license.
