The purpose of this Part is to provide for the recovery of costs from users of the POTW for the implementation of the program established herein. The applicable charges for fees shall be set forth by the Superintendent.

In the event any user discharges industrial wastes to the POTW in excess of 300 milligrams per liter of suspended solids, and/or an average of five day BOD in excess of 250 milligrams per liter, it shall pay a surcharge based upon the excess strength of its wastes. The amount of the surcharge shall be determined by using the following formulas:
Biological Oxygen Demand
(BOD: 250 mg/l x 8.34 x MGD x treatment cost per pound =)
Suspended Solids
(TSS: 300 mg/l x 8.34 x MGD x treatment cost per pound =)
Surcharge
The cost per pound for treatment will be determined by the Superintendent of the POTW and will be based on actual cost of treatment.

The Superintendent may adopt charges and fees which may include:
A. 
Fees for reimbursement of costs of setting up and operating the POTW's pretreatment program.
B. 
Fees for monitoring, inspections and surveillance procedures.
C. 
Fees for reviewing accidental discharge procedures and construction.
D. 
Fees for permit application.
E. 
Fees for filing appeals.
F. 
Fees for consistent removal by the treatment plant of pollutants otherwise subject to federal pretreatment standards.
G. 
Other fees as the Superintendent may deem necessary to carry out the requirements contained herein.

These fees relate solely to the matters covered by this Part and are separate from all other fees chargeable by the Borough or city.
