An assessment is hereby imposed upon the residents of Warminster Township, Bucks County, Pennsylvania pursuant to the Second Class Township Code, Section 2003(a)(2).[1]

The following terms shall have the following meanings when used in this Part 6:
DEVELOPMENT
Any subdivision or land development in Warminster Township, including any individual section of a subdivision or land development.
PERSON
Any individual, corporation, partnership or other business entity, including a homeowners' or condominium association.
PROPERTY OWNER
Any person who owns property in Warminster Township, including but not limited to condominium owners, municipalities, municipal authorities and homeowners' associations.
STREETLIGHT
Any light owned or intended to be owned and operated by Warminster Township which is erected for the purpose of illuminating a public street in Warminster Township.
STREETLIGHTING DISTRICTS
A development, area, subdivision, apartment complex or other combination of parcels, developments, areas, subdivisions or apartment complexes where the assessment for the streetlights located on all of the streets included in the streetlighting district are divided evenly by the property owners in the streetlighting districts.

The purpose of the assessment levied by this Part 6 shall be to provide funds for the cost of streetlights in Warminster Township.

The following method of assessment of streetlighting costs shall constitute the sole method of assessment in Warminster Township:
1. 
For each streetlighting district, except Warminster Heights:
A. 
The streetlighting bill shall be the sum of the following:
(1) 
The previous year's total electricity bill;
(2) 
An additional 10% of that annualized electricity bill as an administrative fee;
(3) 
The total actual cost of maintenance for the streetlighting district for the previous year; and
(4) 
An additional 5% as a restricted capital reserve fund, the proceeds of which shall only be used for costs associated with repair or replacement of streetlighting in the applicable streetlighting district.
B. 
That resulting sum shall be divided by the total number of property owners in the streetlighting district and the quotient shall be the per-property-owner charge.
C. 
The per-property-owner charge should be assessed to each property owner in that streetlighting district.
D. 
The calculation set forth in the above subsection shall be made each January prior to the issuance of tax bills.
2. 
For Warminster Heights:
A. 
The streetlighting bill shall be the sum of the following:
(1) 
The previous year's total electricity bill;
(2) 
An additional 10% of that annualized bill as an administrative fee; and
(3) 
The total actual cost of maintenance for Warminster Heights for the previous year.
B. 
The total bill should be sent to the Warminster Heights Homeowners' Association.

1. 
The Tax Collector of Warminster Township shall collect the assessment imposed by this Part 6. The assessments for streetlights shall be filed with the Township Tax Collector for collection in the same manner as Township taxes are collected.
2. 
If said assessment is uncollected, the same shall be a lien and shall be collectable in the same manner as other municipal claims.
3. 
The Township Tax Collector shall be entitled to the same commission as (s)he is entitled to for the collection of other Township taxes.
4. 
All assessments under this Part 6, when collected, shall be paid over to the Township Treasurer, who shall receive and keep same in a separate account and pay out the same only upon orders signed by the Chairman of the Board of Supervisors, attested by the Secretary. The Tax Collector and the Treasurer shall make a report to the auditors of the Township annually.

Editor's Note: Ordinance No. 731 stated that the Township Board of Supervisors originally created the Ann's Choice Street Light District by Ord. No. 602, adopted 8/14/2003; and that Ord. No. 642 consolidated various streetlight districts and inadvertently omitted Ann's Choice and inadvertently repealed Ord. No. 602. Ordinance No. 731 reestablished the Ann's Choice Streetlight District and stated that the method of assessment in § 21-604 of the Township Code applies.
