The purpose of this article is to set a fee schedule to cover increased costs of managing the present municipal sanitary landfill operated by the Town of Wilna, in anticipation of the costs of closure of the landfill operation.
Large industrial users and commercial haulers shall submit to the Town Clerk a billing system to ensure accurate record keeping of such users in connection with the landfill operation. It shall be the responsibility of such users to implement a system of billing procedures.
The following fee schedule shall be implemented upon the adoption and filing of this article, and the fees shall be paid to the gate attendant and/or Deputy Town Clerk:
Automobiles with trailers, pickup trucks with racks, and trailers with racks shall be measured as to content by the landfill attendant to determine the number of cubic yards, in accordance with the fee schedule herein.
In the event of controversy concerning the size or capacity of any such vehicle transporting material to the landfill, the landfill attendant shall take a photograph of the vehicle, record the size and carrying capacity of the vehicle and refer the matter to the Town Clerk of the Town.
Nonpayment of fees by any user for more than five days after payment due date shall be a ground for denial of further landfill privileges.
All such controversy involving charges to be made or levied by the Town in accordance with this article shall be referred to the Town Board where the decision shall be final.
