[HISTORY: Adopted by the Town Board of the Town of Wilna 7-14-2003 by L.L. No. 1-2003. Amendments noted where applicable.]
The Town Board of the Town of Wilna pursuant to the authority granted it under § 189 and Article 11-A of the Town Law and §§ 10 and 20 of the Municipal Home Rule Law of the State of New York, hereby enacts as follows.
The Town Board of the Town of Wilna has determined that it is in the public interest of the Town of Wilna to establish a joint fire district within the Town of Wilna encompassing the entirety of Village of Carthage and that portion of the Town of Wilna Fire Protection District previously serviced by the Village of Carthage Fire Department as a fire protection contract. Said joint fire district, having been duly established in accordance with Article 11-A of the Town Law, it is necessary under § 189-c[1] to alter, diminish and amend the existing district; said diminishment to coincide with the effective date of the Joint Fire District. It is the purpose of this chapter to accomplish the same.

Editor's Note: Town Law § 189-c, relating to dissolution of an existing district, was repealed by L. 2009, c. 74, § 14, effective 3-21-2010. This law created Article 17-A, Consolidation and Dissolution of Local Government, of the General Municipal Law. Title 3 of said Article 17-A pertains to dissolution of local government entities.
The boundaries of the existing Wilna Fire Protection District shall be altered, diminished and amended to exclude that portion of said Wilna Fire Protection District being encompassed by the Town of Wilna - Village of Carthage Joint Fire District (Carthage/Wilna Fire District) effective as of midnight on December 31, 2003, pursuant to the provisions of §§ 172-d, 185 and 189-c of the Town Law.[1] Said remaining contract coverage areas not effected by the formation of said Joint Fire District shall remain in effect.

This chapter is adopted subject to permissive referendum.
If any part of this chapter shall be found to be void, voidable, or unenforceable for any reason whatsoever, it shall not affect the validity or enforceability of any remaining section or provision of this chapter.
