Appropriate sections from the Subdivision and Land Development Ordinance,[1] and other applicable local ordinances, shall be followed in preparing the SWM site plans.

The Township shall not approve any SWM site plan that is deficient in meeting the requirements of this chapter. At its sole discretion and in accordance with this Part, when a SWM site plan is found to be deficient, the Township may either disapprove the submission and require a resubmission, or in the case of minor deficiencies, the Township may accept submission of waiver requests pursuant to § 23-110 of this chapter.
3. 
The following items shall be included in the SWM site plan:
A. 
Provisions for permanent access or maintenance easements for all physical SWM BMPs, such as ponds and infiltration structures, as necessary to implement the Operation and Maintenance (O&M) Plan discussed in Subsection 3C(11) below.
B. 
The following signature block for the Township:
"(Township official or designated plan reviewer per § 23-403.1 of this chapter), on this date (Signature date), has reviewed and hereby certifies that the SWM site plan meets all design standards and criteria of the Frazer Township Stormwater Management Ordinance (Chapter 23 of the Frazer Township Code of Ordinances, Stormwater Management), except where waivers have been granted as noted on the Plan. The review is based on a survey and plan prepared by others and assumes that all information is correct and valid as submitted."
C. 
The SWM site plan shall provide the following information:
(1) 
The overall stormwater management concept for the project.
(2) 
A determination of site conditions in accordance with the BMP Manual.[2] A detailed site evaluation shall be completed for projects proposed in environmentally sensitive areas, such as brownfields.

(3) 
A key map showing the development site's location within the Township's stormwater management districts, watersheds and subareas. On all site drawings, show the boundaries of such district(s), watershed(s) and subarea(s) as they are located on the development site and identify their district and watershed names and applicable subarea numbers.
(4) 
Location of the 100-year floodplain on the development site based on the current Flood Insurance Rate Maps for the Township.
(5) 
Stormwater runoff design computations and documentation as specified in this chapter, or as otherwise necessary to demonstrate that the maximum practicable measures have been taken to meet the requirements of this chapter, including the recommendations and general requirements in § 23-301 of this chapter.
(6) 
Expected project time schedule.
(7) 
A soil erosion and sediment control plan, where applicable, as prepared for and submitted to the approval authority.
(8) 
The effect of the project (in terms of runoff volumes, water quality, and peak flows) on surrounding properties and aquatic features and on any existing stormwater conveyance system that may be affected by the project.
(9) 
Plan and profile drawings and details of all SWM BMPs, including drainage structures, pipes, open channels, and swales.
(10) 
The SWM site plan shall show the property lines, dimensions of the site and the locations of existing and proposed on-lot wastewater facilities and water supply wells, property boundaries, existing and proposed topography, point(s) of interest, utilities, and potential utility conflicts.
(11) 
The SWM site plan shall include an O&M plan for all existing and proposed physical stormwater management facilities. This plan shall address long-term ownership and responsibilities for O&M including type and schedule/frequency of maintenance activities, personnel and equipment requirements, estimated annual maintenance costs, and method of financing continuing O&M.
(12) 
A justification, acceptable to the designated plan reviewer, must be included in the SWM site plan if BMPs other than green infrastructure methods and LID practices are proposed to achieve the volume, rate and water quality controls under this chapter.
(13) 
Certification and seal of the qualified professional responsible for the preparation of the plans and report.
(14) 
Watershed maps delineating predevelopment and postdevelopment watershed boundaries and land cover conditions, as well as the flow path and segments used to determine time of concentrations for each watershed.
(15) 
Storm sewer calculations and watershed maps delineating all subareas used to size and compute flow for storm sewer system.
(16) 
Existing contours at intervals of two feet except in areas with slopes greater than 15%, in which case five-foot contour intervals may be used.
(17) 
Contours of the finished project site at intervals of two feet, except in areas with slopes greater than 15%, in which case, five-foot contour intervals may be used.

1. 
Up to seven copies of the SWM site plan shall be submitted as follows:
A. 
Five copies to the Township, with one electronic copy in a format acceptable to the Township.
B. 
One copy to the Township Engineer (when applicable).
C. 
One copy to the Conservation District (when requested by the Conservation District).

1. 
Prior to submitting a SWM site plan to the Township, applicants are urged to consult with the Township, the county planning agency and the Conservation District on the requirements for safely managing stormwater runoff from the development site in a manner consistent with this chapter and the applicable watershed stormwater management plans. These agencies may be helpful in providing the data that is necessary for preparing the SWM site plans.
2. 
Applicants are encouraged to submit a sketch plan with a narrative description of the proposed stormwater management facilities for general guidance and discussion with the Township and other agencies.
3. 
The preapplication consultation is not mandatory, and any review comments provided by the Township or other agencies are advisory only and do not constitute any legally binding action on the part of the Township or any county agency.

1. 
General.
A. 
Township approval of a SWM site plan shall be required prior to the commencement of any regulated activities, except as provided for in § 23-302 of this chapter. The Township shall review a SWM site plan for consistency with the purposes, requirements, and intent of this chapter in accordance with the process set forth with this Part. The Township shall approve or disapprove a SWM site plan in accordance with the process set forth in this § 23-404.
B. 
It shall be unlawful for any person to undertake any earth disturbance activity or regulated activity on any property unless a SWM site plan has been approved by the Township in accordance with the requirements of this chapter. It shall be unlawful for any person to make any modifications to a Township-approved SWM site plan unless such modifications have been approved by the Township pursuant to the requirements of this chapter.
C. 
Any request for a waiver from the provision(s) of this chapter shall proceed in accordance with § 23-110 of this chapter.
D. 
For any SWM site plan that proposes to use any BMPs other than green infrastructure and LID practices to achieve the volume and rate controls required under this chapter, the Township will not approve the SWM site plan unless it determines that green infrastructure and LID practices are not practicable.
E. 
The applicable fees and deposit, in accordance with Part 7 of this chapter, must accompany a resubmission of a disapproved SWM site plan.
2. 
Board of Supervisors Approval Process. If the SWM site plan involves a subdivision or land development plan, then the Board of Supervisors shall be responsible for approving or disapproving the SWM site plan and such approval process shall be incorporated into the subdivision and land development plan approval process of the Subdivision and Land Development Ordinance (Chapter 22). Further, the applicant shall be required to submit the SWM site plan with the preliminary and final subdivision or land development plan application in accordance with the submission requirements and procedures specified in the Subdivision and Land Development Ordinance (Chapter 22).
3. 
Township Engineer Approval Process. If a SWM site plan is not part of a subdivision or land development plan, then the Township Engineer shall be responsible for approving or disapproving the SWM site plan in accordance with the following process:
A. 
The Township Engineer shall act upon a SWM site plan no later than 90 calendar days following the date of filing of an administratively complete application, unless the applicant has agreed, in writing, to an extension of this deadline.
B. 
A letter indicating approval, approval with conditions, or disapproval shall be in writing and shall be communicated to the applicant personally or mailed to him at his last known address within 15 calendar days following the Township Engineer's decision. If the application is not approved in terms as filed, then the decision letter shall specify the defects found in the application and cite the requirements of this chapter or other Township ordinances, statutes or regulations that the applicant has not satisfied.
C. 
The applicant shall accept or reject the conditions attached to any approval either by giving written notice to the Township Engineer or executing the operations and maintenance agreement required by § 23-602 of this chapter within 30 calendar days of the date of the Township Engineer's decision letter. If the applicant fails to give written notice to the Township Engineer regarding acceptance or rejection of the conditions attached to any approval within the required 30 calendar days, then the conditions shall be deemed accepted by the applicant.

The applicant shall file five sets of the application, SWM site plan and any other material required by this chapter with the Code Official using such forms provided by the Township. The applicant shall also file one electronic file of all plans and material as part of the final application. The electronic file shall be in a Township-compatible format.
2. 
The application shall not be considered to be administratively complete and properly filed unless and until all items required by this chapter, including the application fee and deposit, have been received by the filing date.
3. 
The Code Official shall review the application to determine whether all materials required by this chapter have been submitted by the applicant. If all such materials have not been submitted by the applicant, then the Code Official shall reject the application as being administratively incomplete and shall notify the applicant, in writing, citing the specific deficiencies and the specific requirements of this chapter that have not been met and returning the applicant's application fee and deposit.
4. 
The Code Official shall submit one copy of an administratively complete application to the following entities and individuals for review: the Township Engineer; and any other appropriate Township personnel or professional consultants. If the SWM site plan affects one acre or more, the Code Official will notify the Conservation District that the Township has received an application for a land disturbance as required by 25 Pa. Code § 102.42. In cases where the application relates to a project fronting on, or otherwise impacting, an existing or proposed state highway, the Township may require that a copy of the application be submitted to PennDOT for review and comment.
5. 
The Code Official and any other Township personnel or professional consultant, as directed by the Code Official, shall review the application to determine if it is in compliance with this chapter and applicable Township ordinances, statutes, and regulations. The Code Official may prepare a written report of his comments and findings. A copy of any such written report shall be provided to the Township Secretary, Township Engineer, and any other appropriate Township personnel or professional consultant. The other Township personnel and professional consultants shall provide comments and recommendations, including written findings, when directed by the Code Official.
6. 
The Township Engineer shall review the application to determine compliance with this chapter, any other applicable ordinances, statutes and regulations, and sound engineering practices. The Township Engineer shall prepare a written report of his comments, findings, and recommendations. A copy of such written report shall be provided to the Code Official, Township Secretary, and any other appropriate Township personnel and professional consultant.
7. 
The SWM site plan shall be approved or disapproved by the Township in accordance with the appropriate process set forth in § 23-404 of this chapter.

1. 
Requests for modifications to a Township-approved SWM site plan shall be submitted to the Township Engineer in writing, on such forms provided by the Township, in accordance with the requirements of this section. A request under this section shall not be considered to be administratively complete and properly filed unless and until all items required by this chapter, including the application fee and deposit, have been received by the Township by the filing date.
A. 
Criteria.
(1) 
If the plan modification request complies with all of the following criteria, then the Township Engineer shall have the authority to approve or disapprove the plan modification request based upon field inspections, revised SWM site plan, and other documentation acceptable to the Township Engineer:
(a) 
The plan modification is initiated after the commencement of construction activities;
(b) 
The plan modification does not result in any modification to other nonstormwater Township approvals, ordinances, and regulations (e.g., required building setbacks, yards, etc.); and
(c) 
The performance standards of this chapter are satisfied.
(2) 
The Township Engineer shall approve, approve with conditions, or disapprove the plan modification request in writing communicated to the applicant personally or mailed to him at his last known address. If the request is not approved in terms as filed, then the decision letter shall specify the defects found and cite the requirements of this chapter or other Township ordinances, statutes, or regulations that the applicant has not met. A copy of the decision letter shall be provided to the Code Official, Township Secretary, and Board of Supervisors. The Board of Supervisors may issue a stay of the Township Engineer's approval of a plan modification request within five business days of receipt of the Township Engineer's decision letter. If the Board of Supervisors issues any such stay, then the Township Engineer's approval of the plan modification request shall be void and the applicant shall be required to resubmit the plan modification request in accordance with § 23-406.A of this chapter.
B. 
If the plan modification request does not comply with the criteria of § 23-406.A of this chapter, then the SWM site plan must be resubmitted to the Code Official for Township review and approval of an application in accordance with the requirements of §§ 23-401 through 23-405 of this Part.
C. 
As part of any plan modification request filed under this section, the Township may require review, recommendation, and/or approval of such request by DEP or the Conservation District.

A disapproved SWM site plan may be resubmitted, with the revisions addressing the Township's concerns, to the Township in accordance with §§ 23-401 through 23-405 of this Part. The applicable fees and deposit, in accordance with Part 7, must accompany a resubmission of a disapproved SWM site plan.

Upon the Township SWM site plan approval, the compliance with any and all applicable conditions thereof, and receipt of all other approvals required under the applicable Township ordinances, the applicant may commence the construction, installation, and implementation of the approved stormwater management facilities. If development of the project site does not begin within 18 months of the date of Township approval of the SWM site plan, then before doing so, the applicant shall resubmit the SWM site plan to the Code Official to verify that no condition has changed that would affect the feasibility or effectiveness of the previously approved stormwater management facilities. In addition, if for any reason development activities are suspended for 18 months or more, then the same requirement for resubmission of the SWM site plan shall apply. If during development activities the applicant or its successor has knowledge of a changed condition likely to affect the feasibility or effectiveness of the previously approved stormwater management facilities, then the applicant or its successor shall submit to the Code Official a properly revised or annotated SWM site plan. SWM site plan approvals are valid for a period of five years from the date of Township approval, unless otherwise provided in the Township decision letter. If the approved work is on-going at the end of the five-year period, then the developer may apply to the Board of Supervisors for an extension of the SWM site plan approval for a period of up to five years. Thereafter, the developer will be required to apply for and obtain Township approval of a new SWM site plan in accordance with the requirements of this chapter.

The developer shall be responsible for providing the Township with record drawings of all SWM BMPs and stormwater management facilities included in the approved SWM site plan, including, but not limited to, BMP grading, outlet structure configuration and emergency spillway configuration. The record drawings and an explanation of any discrepancies with the construction plans shall be submitted to the Township.
2. 
The record drawing submission shall include a certification of completion signed by a qualified professional verifying that all permanent SWM BMPs and stormwater management facilities have been constructed according to the Township-approved plans and specifications. The latitude and longitude coordinates for all permanent SWM BMPs and stormwater management facilities must also be submitted, at the central location of the BMPs and/or facilities. If any licensed qualified professionals contributed to the construction plans, then a licensed qualified professional must sign the completion certificate. The certification shall also include documentation confirming field-reviewed dewatering times for rate and volume control BMPs. Record drawings shall be provided to the Township in both hard copy and electronic format(s) acceptable to the Township.
3. 
The Township may conduct inspections during construction as it deems appropriate. If inspections performed by the Township reveal deficiencies from the submitted and approved SWM site plan, then the Township may request corrective actions. Any corrective action shall be at the cost of the stormwater management facility owner.
4. 
After receipt of the completion certification by the Township, the Township may conduct a final inspection.
