A.
The Town Board shall approve such individuals and entities ("Town
Board approved electrical inspectors") that shall have the power and
authority to make electrical inspections and reinspections on behalf
of the Code Enforcement Office and as heretofore and hereafter described
and to approve or disapprove the same. In no event, however, will
the cost or expense of such inspections and reinspections be a charge
against the Town of Evans.
B.
Application for authority to inspect shall be made to the Town Clerk and be accompanied by a nonrefundable fee to be set, from time to time, by resolution of the Town Board and as set forth in Chapter 106, Fees.
C.
A certificate of insurance shall be required with minimums to be
set by Town Board resolution.
A.
It shall be the duty of the Town Board approved electrical inspectors
to report, in writing, to the Code Enforcement Office, whose duty
it shall be to enforce all provisions of this code, all violations
or deviations from or omissions of the electrical provisions of the
building code applicable to the Town of Evans and of all local laws,
ordinances and the building code as referred to in this chapter, insofar
as any of the same apply to electrical wiring.
B.
The Town Board approved electrical inspectors shall make inspections
and reinspections of electrical installations in and on properties
in the Town of Evans upon the written request of an authorized official
of the Town of Evans or as herein provided. Town Board approved electrical
inspectors are authorized to make inspections and reinspections of
electrical wiring, installations, devices, appliances and equipment
in or on properties within the Town of Evans where the Code Enforcement
Office deems necessary for the protection of life and property. In
the event of an emergency, it is the duty of the Town Board approved
electrical inspectors to make electrical inspections upon the oral
request of an official or officer of the Town of Evans.
C.
It shall be the duty of the Town Board approved electrical inspectors
to furnish written reports to the proper officials of the Town of
Evans and to owners and/or lessees of property where defective electrical
installations and equipment are found upon inspection.
D.
The Town Board approved electrical inspectors shall authorize the
issuing of a certificate of compliance when electrical installations
and equipment are in conformity with this chapter. It shall direct
that a copy of the certificate of compliance be sent to the Town of
Evans, to the attention of the Code Enforcement Office.
A.
It shall be a violation of this chapter for any person, firm or corporation
to install or cause to be installed or to alter electrical wiring
for light, heat or power in or on properties in the Town of Evans
until an application for inspection has been filed with the Town Board
approved electrical inspectors and the Code Enforcement Office.
B.
It shall be a violation of this chapter for a person, firm or corporation
to connect or cause to be connected electrical wiring in or on properties,
for light, heat or power, to any source of electrical energy supply
prior to the issuance of a temporary certificate or a certificate
of compliance by the Town Board approved electrical inspectors.
A.
A violation of this chapter is hereby declared to be a violation
punishable by a fine not to exceed $250 or imprisonment for a period
not to exceed 15 days, or both.
B.
A person shall be subject to the penalties imposed by this section
in any case where an order to remove any violation of any of the provisions
of this chapter has been served by the Code Enforcement Office upon
the owner, general agent, lessee or tenant of the building, other
structure or tract of land, or any part thereof, or upon the architect,
builder, contractor or anyone who commits or assists in any such violation
and where such person shall fail to comply with such order within
10 days after the service thereof. Each week's continued violation
shall constitute a separate additional violation and shall be punishable
hereunder.
