GENERAL REFERENCES
Village property — See Ch. 83.
The provisions of this section shall be applicable in addition
to any other applicable regulations pursuant to law, rule or regulation.
A.
No person shall engage in any of the following conduct within the
boundaries of the property subject to this section:
(1)
Refusing to produce a valid identification card upon a lawful request
by a police officer, peace officer or any person authorized by the
Board to make such request.
(2)
Bicycling (including unicycles, tricycles and other forms of bicycles),
rollerblading, rollerskating or skateboarding.
(3)
Riding or operating a motorcycle, motorbike or moped or other motorized
mode of transportation.
(4)
Consuming any alcoholic beverage or possessing any open container
containing an alcoholic beverage with intent to consume the same.
(5)
Performing or engaging in any unlawful act, including, without limitation,
making or causing unreasonably loud or raucous noise, disturbing the
peace or committing any nuisance.
(6)
Mutilating, defacing or otherwise damaging or removing any Village
property.
(7)
Throwing or depositing any wastepaper, newspaper, boxes or rubbish
of any kind upon Village property except in receptacles provided for
such purpose.
(8)
Posting or distributing any card, pamphlet or circular within the
premises without the prior written consent of the Board of Trustees.
(9)
Hawking or peddling, or soliciting funds for any purpose.
(10)
Holding any meeting or demonstration, without the prior written
consent of the Board of Trustees.
B.
Any person who violates any rule or regulation provided herein shall
be subject to punishment as provided in the Village Code for violations
of that Code. In addition, any person found or observed to be in violation
of any rule or regulation provided herein may be excluded from use
of the property.
A.
The property ("Village Hall property") owned by the Village of North
Hills, located west of Shelter Rock Road, and known by the post office
address of One Shelter Rock Road, shall not be used for any purpose
other than governmental purposes of the Village of North Hills, or
for a purpose as otherwise permitted by this section or as required
by law.
B.
Except to the extent specified herein, or except when any portion
of such property is in use for an activity open to the general public
pursuant to this section, no part of the Village Hall property shall
be considered a public forum in whole or in part. Any portion of the
Village Hall property in use for a purpose specified in this subsection
shall be considered a limited public forum, only for such use and
only during the period of such authorized use.
C.
With permission from the Village Administrator, and provided that
adequate portions of the Village Hall property are reasonably available
and are not otherwise scheduled for other permitted use, the Village
Hall property, or any part thereof, may be used (i) for a governmental
purpose by any governmental entity other than the Village of North
Hills, or (ii) for a similar use by or on behalf of boards of condominiums
or homeowners' associations whose members consist solely of Village
residents or owners of property in the Village.
D.
With the permission of the Board of Trustees, and provided that adequate
portions of the Village Hall property are reasonably available and
are not otherwise scheduled for other permitted use, the Village Hall
property also may be used for noncommercial activities which provide
significant benefits to the residents of the Village of North Hills
which would, in the opinion of the Board of Trustees, not otherwise
be available to residents.
E.
Outdoor portions of the Village Hall property present used pursuant
to existing leases, or renewals, extensions or amendments thereof,
may continue to be used for such purposes pursuant to the terms of
such leases, renewals, extensions of amendments.
F.
Except for materials to be used in conjunction with and in furtherance
of an authorized use of the Village Hall property, no signs or other
objects, materials or structures, may be placed or distributed anywhere
on such property without the permission of the Board of Trustees.
The Board of Trustees may delegate to one or more public officers
of the Village the authority to grant such permission in any or all
cases. Any signs or other objects, materials or structures placed
on such property without required permission shall be deemed abandoned,
and may be removed and disposed of in the sole discretion of the Village.
G.
The Board of Trustees, acting by resolution, may establish and amend
a schedule of fees for use of the Village Hall property, or any part
thereof.
H.
No person shall on any part of the Village Hall property:
(1)
Refuse to produce a valid identification card upon a lawful request
by a police officer, peace officer or any person authorized by the
Board to make such request.
(2)
Except where authorized by the Board of Trustees, consume any alcoholic
beverage or possess any open container containing an alcoholic beverage
with intent to consume the same.
(3)
Perform, encourage or engage in any unlawful act, including, without
limitation, making or causing unreasonably loud or raucous noise,
disturbing the peace or committing any nuisance. As used in this subsection,
"unlawful act" shall include any activity which is obscene or likely
to cause imminent danger or harm to the person or property of one
or more persons.
(4)
Mutilate, deface or otherwise damage or remove any Village property.
(5)
Throw or deposit any wastepaper, newspaper, boxes or rubbish of any
kind except in receptacles provided for such purpose.
(6)
Hawk or peddle, or engage in solicitation of funds.
I.
Any person who violates any rule or regulation provided herein shall
be subject to punishment as provided in the Village Code for violations
of that Code. In addition, any person found or observed to be in violation
of any rule or regulation provided herein may be excluded from use
of the property.
J.
In any case where any portion of the Village Hall property is used
by any person or entity other than a board or agency of the Village,
or another governmental entity, no such use shall occur unless the
person or entity shall maintain adequate insurance, as may be determined
by the Village Administrator, and give satisfactory evidence of same.
For good cause shown, the Village Administrator may waive all or any
part of such insurance requirements. All required liability insurance
policies shall name the Incorporated Village of North Hills its elected
and appointed officials, employees and volunteers as additional insureds,
and shall be documented by policy endorsements. In all cases, the
insurance carrier must be a New York State licensed carrier with an
A.M. Best Rating of at least an A IX.

A.
Except to the extent specified in the Village Code, or as specifically
permitted or required by law, no person shall enter upon, or use,
any Village real property, except with the express permission of the
Board of Trustees. Such permission may be granted on such terms and
conditions as may be determined by the Board of Trustees, which may
include a reasonable fee for such use.
B.
Except to the extent specified in the Village Code, or as required
by law, no part of any Village property shall be considered a public
forum in whole or in part.
C.
