A.
The Town Dog Control Officer of the Town of Malone is hereby instructed
to issue a citation to any person or persons they believe to be in
violation of any of the provisions of this chapter. Any person(s)
subsequently found to be guilty of violating any of the provisions
of this chapter shall, upon conviction thereof of a first offense,
be punished by a fine of no less than $50 nor more than $75. Upon
a subsequent second conviction of any person(s) within a three-month
period from the date of their first conviction under this chapter,
the person(s) shall be punished by a fine of not less than $100, nor
more than $150. Upon a third such conviction within a six-month period
from the date of their first conviction under this chapter, the person(s)
shall then be punished by a fine of not less than $175, nor more than
$225. Upon the fourth such conviction within a one-year period from
the date of their first conviction, the person(s) shall be punished
by a mandatory fine of $300.
B.
In addition to the fine imposed by Subsection A of this section of this chapter, the Malone Town Justice before whom any violator(s) of this chapter is convicted shall have the power and the authority to order such person(s) to compensate the owner of any private or public property for the damage done to such property by the animal of the violator.
C.
Should it become necessary for the Village of Malone designated Dog/Animal
Control Officer to seize an animal, the seizure fee shall be $150
per animal per seizure.
