This chapter shall be known as the "Pine Grove Borough Zone
Emergency Management Agency Ordinance."
The Borough of Pine Grove hereby resolves to create a Pine Grove
Borough Zone Emergency Management Agency.
The purpose of the Pine Grove Borough Zone Emergency Management
Agency would be to function as the Emergency Management Agency for
the Borough of Pine Grove in accordance with the Emergency Management
Service Code, 35 Pa.C.S.A. § 7101 et seq., as amended.
The responsibilities of the Pine Grove Zone Emergency Management
Agency are generally but not limited to the following:
A. The Borough of Pine Grove shall take steps to assure the formation
of the Pine Grove Borough Zone Emergency Management Agency, said organization
to be responsible for functioning as the Emergency Management Agency
in the Borough of Pine Grove, which shall prepare and maintain an
Emergency Operations Plan that can and will be implemented for response
to emergencies affecting the Borough of Pine Grove.
B. The Borough of Pine Grove shall appoint two individuals to serve
as members of the Pine Grove Borough Zone Emergency Management Council,
which will have planning and resource development responsibility for
emergency operation within the territorial limits of Pine Grove Borough
Zone Emergency Management Agency. Action taken by the Pine Grove Borough
Zone Emergency Management Council must be ratified by the individual
municipality governing bodies, as provided in the EMS Code.

C. The Pine Grove Borough Zone Emergency Management Council will recommend
one of the individuals named to the Council to serve as the Zone Emergency
Management Coordinator and other to serve as Deputy Emergency Management
Coordinator of the Pine Grove Borough Zone Emergency Management Agency,
would have responsibility for operational control of emergency response
operation within the territorial limits of the Pine Grove Borough
Zone Emergency Management Agency. The Zone Emergency Management Coordinator
will be subjected to the direction and control of the elected officials
of the municipality affected by the emergency situation. In the event
of an emergency, Borough President is to be contacted and made aware
of the situation. In the event that this individual is not in the
area, the Vice President of the Borough is to be contacted. If two
or more municipalities are affected by the emergency situation, the
Zone Emergency Management Coordinator shall be subjected to the direction
and control of the elected officials of the Court as required by the
EMS Code.
D. The Borough of Pine Grove will be responsible for expenses incurred
during the emergency within its boundary. In the event the emergency
encompasses dual municipalities and Pine Grove Borough Zone Emergency
Management Agency's services are required to assist any encompassing
municipality, all attempts will be made to keep track of separate
costs.
E. The manner in which property, real and personal, shall be acquired,
managed, and disposed of, will be at the discretion of the Coordinator
and Deputy Coordinator, providing such information to the Borough
of Pine Grove before purchase or disposal.
All resolutions and ordinances, or parts of either, which are
inconsistent herein, are hereby repealed to the extent of such inconsistency.
The invalidity of any part of this chapter shall not effect
the validity of any other part of this chapter.
A copy of this chapter shall be filed with the County Emergency
Management Agency and shall remain in affect unless amended. Any amendments
shall also be filed with the County Emergency Management Coordinator.
This chapter shall be, effective upon enactment by the Borough
Council of Pine Grove, Schuylkill County, Pennsylvania, resolved and
enacted by the Borough Council of Pine Grove, Schuylkill County, Pennsylvania
on the 14th day of April, 2005.
