There is hereby created and established a Police Department within the Borough of Pine Grove, to be known as the "Pine Grove Borough Police Department" composed of the Police Board, Police Civil Service Commission, and Police Force, as more fully provided for herein below.[1]

A. 
Consistent with § 1172 of the Borough Code (8 Pa.C.S.A. § 1172), there is hereby created and established a civil service commission within the Borough of Pine Grove, to be known as the "Pine Grove Civil Service Commission."

B. 
The Commission shall consist of three individuals, each of whom shall be a resident and qualified elector of the Borough who shall each be appointed by the Council to a six-year term; one Commissioner shall be appointed at the first meeting of each session of the Council in each even-numbered calendar year during which a term of a Commissioner will terminate; each term for a Commissioner shall commence February 1 and terminate January 31 six years thereafter. Provided, however, that not later than the Council meeting which next follows the meeting at which this chapter is enacted, the Council shall appoint three individuals as Commissioners to serve under this chapter.

C. 
Vacancies in the Commission occurring for any reason shall be filled within 30 days, by appointment by the Council of a successor to serve for the remainder of the term of the individual being replaced. A vacancy shall occur in the case any member resigns, ceases to be active by failure to attend three successive meetings of the Commission and the Board, ceases to be a resident of the Borough, or otherwise becomes disqualified for appointment or membership. The person creating any incompatible composition under § 41-8, shall be the person disqualified for appointment and whose position becomes vacant under this subsection.
D. 
Each individual appointed as a member of the Commission, before entering upon the discharge of the duties of his office, shall take an oath or affirmation to support the Constitution of the United States and of the Commonwealth of Pennsylvania and to perform his official duties with fidelity, together with such loyalty oath as is prescribed and required by law.
E. 
The Commissions shall receive no compensation.
A. 
No member of the Commission shall hold an elective or appointed office under the United States Government, the Commonwealth of Pennsylvania or any political subdivision of the Commonwealth, including specifically that no member shall be an elected or appointed official or employee of the Borough or School District and most particularly that no member shall be a regular policeman, including the Police Chief; an auxiliary policeman; a special policeman; a fire policeman; a special school policeman or crossing guard; an employee of the Agency; an employee of the Department; or any other employee of the Borough as defined under Act of June 2, 1915, P.L. 736, Art. I, § 104, as amended by Act of March 29, 1972, P.L. 159, No. 61, § 1 (77 P.S. § 22), as modified by July 11, 1980, P.L. 577, No. 121, § 1 (77 P.S. § 1062), and as may hereafter be amended or modified.
B. 
Exceptions.
(1) 
The following exceptions to Subsection A of this section shall be allowed:
(a) 
One member of the Commission may be a member of the Council other than the President or Vice President;
(b) 
One member of the Commission may be a member of the Agency other than a member who is also a member of Council.
(c) 
One member of the Commission may be a member of the teaching profession other than a member who is also a member of Council.
(2) 
Provided, however, that not more than two members of the Commission shall be appointed thereto under the exceptions provided for in this subsection.
A. 
The Commission shall organize on or before the first Monday of February of each even-numbered calendar year and in no event later than the tenth day of February of such year; provided, however, that not later than 10 days after the initial appointments provided for in § 41-7B are made, the Commission shall initially organize.
B. 
The Commission shall appoint one of its members as the Chairman and one as the Secretary for the Commission who shall also be considered as the Vice Chairman to act in the temporary absence of the Chairman; and, when a vacancy in the Commission is filled by the Council under § 41-7C which vacancy is that of the member who was the elected Chairman or Secretary, the Commission shall reorganize for the remainder of the session ending on the last day of January of the next following even-numbered calendar year.[1]

A. 
The commission shall hold regular meetings not less than bimonthly. These shall be advertised and conducted according to applicable law.

B. 
Special meetings of the Commission may be called by the Chairman for the Commission with not less than 24 hours' written notice to each Commissioner by the secretary for the Commission.[1]

C. 
The order of business at all meetings shall be as follows:
(1) 
Opening.
(2) 
Roll call.
(3) 
Secretary's report of minutes of prior meeting.
(4) 
Hearings, including continued hearings, as may be necessary (Commission only).
(5) 
Financial report (Board only).
(6) 
Police Chief report (Board only).
(7) 
Unfinished business.
(8) 
New business.
(9) 
Communications.
Two members of the Commission shall constitute a quorum; and no action of the Commission shall be valid unless it shall have the concurrence of at least two members.[1]
