This chapter shall be known as and may be cited as the "Pine Grove Stoves and Chimneys Ordinance."
The intent of this chapter is to:
A. 
Promote the general health, welfare, and safety of the Borough of Pine Grove;
B. 
Encourage the utilization of appropriate installation and construction of wood or coal burning stoves and appliances, chimneys, fireplaces, and smoke pipes to prevent or minimize fire hazards from same in the future;
C. 
Minimize damage to public safety by reducing the risk of fire; and
D. 
Establish standards for installation and construction of wood or coal burning stoves and appliances, chimneys, fireplaces, and smoke pipes.
It shall be unlawful for any person, partnership, business, association, or corporation to undertake, or cause to be undertaken, any installation or construction, including any reconstruction, enlargement, replacement, alteration, or relocation, of any wood or coal burning stove or appliance, chimney, fireplace, or smoke pipe anywhere within the Borough of Pine Grove unless a permit has been obtained from the Borough Secretary and such installation and/or construction has been inspected and the permit approved by the Fire Marshal.
A. 
Unless specifically defined, words or phrases used shall be interpreted so as to give them the same meaning as they have in common usage and so as to give this chapter its most reasonable application.
B. 
When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular, words in the singular include the plural, and words either in the feminine, masculine or neuter shall include words of the other two genders.
C. 
The word "shall" is always mandatory and not merely directory.
D. 
The following are specific definitions:
BOROUGH SECRETARY
The permit officer who is the secretary of the Borough of Pine Grove.
INSPECTOR
The enforcement officer, Fire Marshal, who shall be a qualified person designated by the Pine Grove Borough Council annually.
A. 
The degree of fire protection sought by the provisions of this chapter is considered reasonable for regulation purposes. This chapter does not imply that compliance with its provisions will totally eliminate the risk of fire from those items regulated herein.
B. 
The chapter shall not create liability on the part of the Borough or any officer or employee thereof for any fire damages that result from reliance on this chapter or any administrative decision lawfully made thereunder. No permit issued under the provision of this chapter shall be considered to provide a warranty of any kind by the Borough or any officer or employee thereof.
