There is hereby created and established an Educational Service
Agency within the Borough of Pine Grove as more fully provided for
herein.
The Agency shall be composed of three individuals, each of whom
shall be a resident of the Borough of Pine Grove, at least 18 years
of age.
A.
The Borough Council shall appoint one individual to serve as a member
of the Agency for a three years term at the first meeting of the Council
held each calendar year. The term of each person shall commence on
the first day of February of the year of his appointment and continue
until the last day of January three years after the year of this appointment.
Provided, however, that not later than the council meeting which next
follows the meeting at which this chapter is enacted, the Borough
Council shall appoint three individuals as members of the Educational
Service Agency designating one to serve until the last day of January
next following such appointment, one to serve until the last day of
January one year beyond that next following such appointment, and
one to serve until the last day of January two years beyond that next
following such appointment.
B.
Vacancies in the Agency occurring for any reason shall be filled
by appointment by the Borough Council of a successor to serve for
the remainder of the term of the individual being replaced. A vacancy
shall occur in the case any member ceases to be a resident of the
Borough or otherwise becomes disqualified for appointment or membership.
No member of the Agency shall hold an elective office under
the United States government, the Commonwealth of Pennsylvania, the
County of Schuylkill, or the Borough nor shall such member be an elected
or appointed official or employee of the Pine Grove Area School District,
except that one member may be a member of the Pine Grove Borough Council.
The members of the Educational Service Agency shall receive
no compensation for their services, except as may be fixed from time
to time by the Borough Council who are not elected or appointed officers
or employees under the United States government, the Commonwealth
of Pennsylvania or any political subdivision of the commonwealth,
but such compensation shall never exceed 2/3 the compensation provided
for members of the Pine Grove Borough Council.
The Educational Service Agency shall organize not later then
the last day of February each year and shall elect one of its members
as the Chairman and one as the secretary treasurer.
