The following
uses and acts are prohibited in all Township-owned parks:
A.
The carrying
or usage of a lighted cigarette, cigar, pipe, or other lighted smoking
device; or an electronic cigarette or vaporizer, or smokeless tobacco
products, including look-a-like or similar products, on or within
the limits of Township-owned park properties is hereby declared to
be unlawful, and Township police officers shall have the power to
remove any individual from Township-owned property for a violation
of this section and issue a citation. Ross Township parks and facilities
are hereby designated tobacco-free areas.
B.
The Director
of Public Works is hereby directed to post the appropriate signage
indicating that all Ross Township parks and facilities are tobacco-free
areas and that violators will be ejected immediately from any park
or facility.

The provisions of this Part are severable, and if any section,
sentence, clause, part or provision hereof shall be held illegal,
invalid or unconstitutional by any court of competent jurisdiction,
such decision of the court shall not affect the remaining sections,
sentences, clauses, parts or provisions of this Part. It is hereby
declared to be the intent of the Board of Commissioners that this
Part would have been adopted if such illegal, invalid or unconstitutional
section, sentence, clause, part or provision had not been included
herein.

Penalties for Public. Any person who violates any provision
of this Part shall, upon conviction by a District Magistrate, be subject
to a fine of not less than $100 nor more than $1,000.
