[HISTORY: Adopted by the Board of Trustees of the Village of Dering Harbor 4-14-1984 by L.L. No. 2-1984. Amendments noted where applicable.]
This chapter is the "Local Law Establishing a Planning Board in the Village of Dering Harbor."
A. 
The Board of Trustees finds that the orderly development of the Village of Dering Harbor requires the establishment of a Planning Board.
B. 
Accordingly, the Board of Trustees finds and determines that pursuant to § 7-718 of the Village Law of the State of New York a Planning Board be and herewith is established.

A. 
The Board of Trustees shall serve as the Planning Board with terms co-terminus to their terms on the Board of Trustees.
B. 
Chairperson. The Mayor shall serve as the Chairperson and the Deputy Mayor shall serve as Vice Chairperson.
C. 
Compensation. The Planning Board members shall serve without compensation.
D. 
Meetings of the Planning Board. The meetings of the Planning Board shall be held and duly noticed separate from the meetings of the Board of Trustees.

Editor's Note: This local law also provided the following:
"Section 2. Terms of existing Planning Board Members. The terms of existing Planning Board members shall terminate upon the effective date of this local law.
"Section 3. First term of the Board of Trustees as the Planning Board. The first terms of the Board of Trustees as members of the Planning Board shall commence upon the effective date of this local law.
"Section 4. Authority and supercession. The proposed local law is enacted pursuant to Village Law § 7-718, as well as Municipal Home Rule Law § 10(1)(i), 10(1)(ii)(a)(1), 10(1)(ii)(a)(12), 10(1)(ii)(e)(3), and 10(2), and expressly supersedes all inconsistent provisions of Village Law § 7-718, including the eligibility provisions of § 7-718(3) and other provisions related to the appointment and terms of planning board members."

The Planning Board is given jurisdiction pursuant to Village Law Article 7, §§ 7-718, 7-728, 7-730 and 7-732.
The Planning Board may retain an attorney and/or professional engineers by resolution and where budget provision is made therefor by the Board of Trustees.
This chapter shall take effect upon its filing with the Secretary of State.
