This chapter shall be entitled "Local Law of 2002 of the Incorporated Village of Dering Harbor, A Local Law Prohibiting Hunting and Trapping in the Village of Dering Harbor."
Pursuant to § 10 of the Home Rule Law and the Village Law of the State of New York the Incorporated Village of Dering Harbor, County of Suffolk and State of New York, hereby enacts by this local law of 2002, a local law of the Village of Dering Harbor.
This chapter shall take effect on the filing of the approved local law with the Secretary of State of New York, which shall be within 20 days after its approval by the Board of Trustees of the Incorporated Village of Dering Harbor.
The Board of Trustees of the Village of Dering Harbor hereby determines and finds that, due to the development of the Village, the increase in the number and density of residents, families and their guests residing in and enjoying their properties, as well as the Village and its assets, and the proximity of their homes and properties, that hunting and trapping of all types imposes a severe hazard and threat to the health, safety and welfare of the residents of the Village, and their families and guests, and that it is in the best interests of the Village, its residents and property owners to adopt a local law establishing regulations prohibiting hunting and trapping in the Village of Dering Harbor.
The purpose and intent of this chapter is to protect the health, safety and wellbeing of the residents of the Village of Dering Harbor, and their residents, families and guests through the banning of hunting and trapping in the Village of Dering Harbor.

Hunting and trapping of all types is hereby prohibited within the Village of Dering Harbor except on properties exceeding five acres in area or where the landowner has obtained a NYSDEC deer damage permit.
There shall be a fine of $250 for each violation of this chapter, plus such other penalty as a court of competent jurisdiction shall deem just and proper.
In the event that any section or portion of this chapter shall be deemed to be unenforceable or of no effect, the remainder of this chapter shall survive and remain in full force and effect.
