There is hereby created the Office of the Municipal Attorney of the Borough of Woodland Park.

Pursuant to N.J.S.A. 40A:9-139, the Municipal Attorney shall be a duly qualified attorney-at-law of the State of New Jersey. The Municipal Attorney shall be appointed by the Mayor with the advice and consent of the Council and shall hold office for a term of one (1) year, and until a successor is duly appointed and qualified. Vacancies shall be filled for the unexpired portion of a term.

The Attorney shall be the legal advisor of the Council and all officers of the various municipal boards which are not represented by their own counsel in all matters involving their duties and business as officers of the Municipality. The Municipal Attorney shall perform his or her duties in accordance with the laws of the State of New Jersey and ordinances of the municipality.

The office of the Municipal Attorney shall be a part-time office and the Municipal Attorney shall receive compensation as prescribed in the annual salary ordinance adopted by the Mayor and Council for attendance and advice at meetings of the Council. The Municipal Attorney shall receive other compensation for additional legal duties performed as authorized by the Mayor or the Council.

There is hereby created the Office of Prosecutor of the Borough of Woodland Park. The Prosecutor shall serve under the supervision of the Attorney General or County Prosecutor who may represent the State, County or Municipality in any matter within the jurisdiction of the Municipal Court.

The Prosecutor shall be an attorney-at-law of the State of New Jersey and shall be appointed by the Mayor with the advice and consent of the Council and shall hold office for a term of one (1) year.

The duties of the Prosecutor shall be to attend all sessions of the Municipal Court, to represent all municipal boards, officers or employees in any complaints filed by such boards, officers or employees in the Municipal Court, and to prepare and prosecute all cases of a criminal nature or a quasi-criminal nature, including violations of the ordinances of the municipality, or any other cases cognizable in the Municipal Court which the Judge of the Municipal Court deems proper to be prepared and presented by the Prosecutor.

There is hereby created the office of Assistant Prosecutor of the Borough.
b. 
Qualifications; Appointment; Term. The Assistant Prosecutor shall be an attorney-at-law of the State of New Jersey and shall be appointed by the Mayor with the advice and consent of the Council and shall hold office for a term of one (1) year.
c. 
Powers and Duties. In the absence of the Prosecutor, the Assistant Prosecutor shall attend all sessions of the Municipal Court of the Borough, represent all municipal Boards, officers or employees in any complaints filed by such Boards, officers or employees in the Municipal Court, and prepare and prosecute all cases of a criminal nature or a quasi-criminal nature, including violations of the ordinances of the Borough or any other cases cognizable in the Municipal Court which the Municipal Judge deems proper to be prepared and presented by the Assistant Prosecutor.

There is hereby created the office of Public Defender.
[Ord. No. 97-12 § 2-28.2]
The Public Defender shall be an Attorney-at-Law of the State of New Jersey in good standing. He or she shall be appointed by the Mayor with the advice and consent of the Council at the annual reorganization meeting of the Mayor and Council and shall hold office for the term of one (1) year from the date of appointment. Vacancies shall be filled for the remaining portion of the term.

Pursuant to and in accordance with P.L. 1997, c. 256, it shall be the duty of the Public Defender to provide a defense for any indigent is charged in Municipal Court with a crime as specified in N.J.S.A. 2B:12-18, or if in the opinion of the Municipal Court Judge there is a likelihood that the defendant, if convicted of any offense other than those specified in N.J.S.A. 2B:12-18, will be subject to imprisonment or other consequence of magnitude, the Public Defender shall represent an indigent defendant with regard to that offense. If there is a vacancy in the office of Municipal Public Defender, if the Municipal Public Defender is temporarily unavailable or if a finding of conflict of interest precludes the Municipal Defender from representing an indigent defendant, the Municipal Prosecutor may prosecute the offense if the Municipal Court appoints a qualified attorney to represent the indigent defendant. Once appointed, the attorney shall carry out all duties of the Municipal Public Defender in connection with the case that is the subject of appointment. The compensation of appointed counsel shall be fixed by the court in accordance with such rates as have been established by the Mayor and Council. If no such rates are then established by the Mayor and Council, appointed counsel shall be entitled to compensation at the same rate as attorneys hired by the Office of the Public Defender of the State of New Jersey in conflict cases, with payment to be made within thirty (30) days.

The office of Public Defender shall be a part-time office and the Public Defender shall receive compensation as prescribed in the annual salary ordinance adopted by the Mayor and Council for his or her fulfillment of the duties enumerated in subsection 2-30.3.

The individual appointed as the Public Defender shall be required to provide a Certificate of Insurance from an insurance carrier authorized to do business in the State of New Jersey and to provide legal errors and omissions coverage, and the certificate shall indicate that the minimum coverage of one million ($1,000,000) dollars errors and omissions insurance has been obtained.

Eligibility for services of the Public Defender shall be determined by the Municipal Court on the basis of the need of the defendant in accordance with P.L. 1997, c.256.

The Borough of Woodland Park hereby requires any person applying for representation by the Public Defender or Court-Appointed Counsel to pay an application fee of two hundred ($200) dollars. This fee shall be paid either upon application or upon direction of the Municipal Court Judge. An application fee may be charged each time a defendant applies for the services of the Public Defender or Court-Appointed Counsel.

In accordance with the guidelines promulgated by the Supreme Court, the Municipal Court may waive any required application fee, in whole or in part, only if the Court determines, in its discretion, upon a clear and convincing showing by the applicant that the application fee representation. The Municipal Court may permit a person to pay the application fee over a specific period of time not to exceed four (4) months.

Funds collected pursuant to subsection 2-30.7 shall be collected by the Borough Administrator and deposited in a dedicated fund administered by the Borough's Chief Financial Officer. Such funds shall be used exclusively to meet the costs incurred in providing the services of the Public Defender including, when required, expert and lay investigation and testimony.

There is hereby created the Office of Municipal Engineer.

The Engineer shall be a duly qualified licensed engineer under the provisions of the laws of the State of New Jersey. The Engineer shall be appointed by the Mayor with the advice and consent of the Council and shall hold office for the term of three (3) years and until a successor is duly appointed and qualified.

The Engineer, when authorized by the Mayor or Council, shall:
a. 
Examine, supervise and inspect the installation and construction of all municipal improvements and all other construction projects that may be performed within the municipality, except the construction which falls within the responsibility of the Building Subcode Official.
b. 
Establish and revise from time to time the standards that are to be maintained with respect to the installation and construct of sanitary sewers, water facilities, roads, curbs, and all other municipal facilities.
c. 
Revise the assessment maps and other maps and profiles of the municipality as may be necessary from time to time.

There shall be a Municipal Auditor appointed by the Mayor with the advice and consent of the Council for a term of one (1) year. The Auditor shall be a registered municipal accountant of the State of New Jersey and shall perform the functions required of him by State law and have other powers and duties as are prescribed by the Council.

There is hereby created the position of Purchasing Agent for the Borough of Woodland Park.

The Purchasing Agent shall be appointed by the Mayor of the Borough of Woodland Park.

The Purchasing Agent is required to possess a valid Qualified Purchasing Agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.

The Purchasing Agent shall have, on behalf of the Mayor and Council of the Borough of Woodland Park, the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.); to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forms and procedures promulgated by state regulatory agencies; and conduct any activities as may be necessary or appropriate to the purchasing function of the Borough of Woodland Park.

Since the Purchasing Agent of the Borough of Woodland Park is required to be qualified in compliance with N.J.S.A. 40A:11-9, the Mayor and Council of the Borough of Woodland Park hereby authorize the bid threshold to be set at the current bid amount ($36,000) authorized by law for a Qualified Purchasing Agent. Said bid amount is hereby authorized to be adjusted without further action on the part of the Mayor and Council in compliance with N.J.S.A. 40A:11-3 c.
