GENERAL REFERENCES
Stormwater management — See Ch. 159.
This chapter establishes water conservation restrictions; and the plan will be in effect at any time the Governor declares by executive order a critical water deficiency, pursuant to M.S.A. § 103G.291 or the City of Breckenridge Mayor declares a local water emergency.
As used in this chapter, the following terms shall have the meanings indicated:
DEPARTMENT
The City Water Department.
DIRECTOR OF PUBLIC SERVICES
The person in charge of the Breckenridge Public Utilities including the water, sewer, and electric departments.
EMERGENCY
The declaration of a critical water deficiency by the Governor or Mayor.
NOTIFICATION TO PUBLIC
Notification through local media, websites, Facebook, social media, including interviews and issuance of news releases.
PUBLIC WATER SUPPLIER
The City or other entity that owns, manages, or operates a public water supply, as defined in M.S.A. § 144.382, Subdivision 4.
WATER EMERGENCY PREPAREDNESS PLAN
A plan that is updated and adopted by the City Council through resolution as often as deemed necessary which insures that water resources are managed correctly in times of a water crisis.
A. 
This chapter applies to all customers of public water suppliers who own or control water use on any premises.
B. 
No person shall make, cause, use, or permit the use of water received from a public water supply for residential, commercial, industrial, governmental, or any other purpose in any manner contrary to any provision in this chapter or pursuant to M.S.A. § 103G.291.
C. 
Mandatory emergency conservation measures shall be implemented based upon the declaration of a critical water emergency by the Governor or Mayor.
Upon the declaration of a critical water deficiency by the Governor or Mayor, the Mayor will issue a proclamation declaring the emergency and the public water supplier shall immediately post notice of the emergency declaration at the usual meeting place of the City Council, or the official City bulletin board. The City shall provide notification to the public as quickly as possible or through procedures established in the Water Emergency Preparedness Plan adopted by the City of Breckenridge.
Upon declaration of a water emergency and notification to the public, restrictions will be enforced according to the Water Emergency Preparedness Plan. Some restrictions shall be, but not limited to: "odd-even" system for lawn and garden watering effectively limiting such use of water to every other day, entirely restricting lawn and garden watering, car washing, and other nonessential water usage during a period of shortage or emergency if proclaimed by the Mayor. If the Director of Public Services determines that further restrictions on water use are needed, such restrictions will be based on the priorities in accordance with M.S.A. § 103G.261.
A. 
Violations shall be determined and cited by the local law enforcement personnel with the assistance of the Director of Public Service.
B. 
A violation of this chapter is a petty misdemeanor.
C. 
When preceded by two or more violations within the immediate preceding twelve-month period, a violation of this chapter is a misdemeanor.
D. 
At the discretion of the Director of Public Services, water service to premises may be terminated, upon giving written notice from the Director of Public Services, for the unauthorized use of water.
