Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in N.J.S.A. 39:1-1 shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the Borough.

a. 
The Mayor or, in his/her absence, disability or inability to act, the Chief of Police and, in the event of his/her absence, disability or inability to act, then the ranking officer of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Mayor and in accordance with Subsection a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed one hundred ($100) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

a. 
Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
b. 
Police Powers. In addition to any and all other powers vested in the Police Department to enforce the regulations of this chapter, the Police Department is given full power and authority to remove by towing at a reasonable cost to the owner any vehicle illegally parked pursuant to this section providing notice thereof is conspicuously posted indicating the street area as a "Tow-Away Zone."

Under another penalty is expressly provided by New Jersey Statute, any person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than fifty ($50) dollars or imprisonment for a term not exceeding fifteen (15) days or both. If any motor vehicle operator is found to have violated this chapter and refuses to pay the same, his or her driving privileges may be suspended by a Court of competent jurisdiction.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

a. 
The Governing Body hereby finds and declares that problems of traffic control occur when traffic must be moved through or around road or street construction, maintenance operations and utility work above or below ground which requires blocking the roadway and obstructing the normal flow of traffic and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work forces performing these operations.
b. 
The Borough of Woodland Park in the County of Passaic, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices, hereafter known as "M.U.T.C.D.," except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility which fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person or contractor, or in the case of a public utility wishing to conduct work on, under or above the roadway, to contact the Traffic Bureau of the Woodland Park Police Department in order to arrange a preconstruction meeting to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Traffic Bureau of the Woodland Park Police Department is in violation of this section. Public utilities conducting routine maintenance work need not comply with the pre-construction meeting requirement.

The person, contractor or utility shall provide the Woodland Park Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contacts cannot be reached or if the emergency contact person does not respond to a call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency services by the Borough shall be charged to the person, contractor or utility responsible for such condition.

a. 
There shall be no construction, maintenance operations or utility work under, on, or above any roadway in the Borough, except in an emergency, before the hour of 9:00 a.m. or after 4:00 p.m.
b. 
This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in Charge of the Traffic Bureau of the Woodland Park Police Department. If it is determined by the Officer in Charge of the Woodland Park Police Traffic Bureau that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. on any roadway would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m.

Road closings and/or traffic detours shall not be permitted unless approved by the Woodland Park Chief of Police.

Traffic directors shall be posted by the contractor, at its expense, at all construction or maintenance sites when determined by the Woodland Park Police that same is necessary to provide for the safety and expeditious movement of traffic.

The Woodland Park Chief of Police shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance, traffic delay and/or safety hazard or for any violation of this section.

a. 
In the case of emergency repair work where construction or maintenance operations or emergency utility work must be performed that will obstruct, interfere or detour traffic on any roadway in the Borough, the person, contractor or utility performing such operation shall notify the Woodland Park Police Department of such emergency operation. The person, contractor of utility shall disclose the nature of the emergency, location and hours of operation.
b. 
All emergency construction and maintenance operations shall be performed with full regard to safety and to keep traffic interference to an absolute minimum. During such emergency repair work, the person, contractor or utility shall comply with the provisions of the M.U.T.C.D. while performing such emergency repair work.

All persons who perform traffic control services pursuant to this chapter shall be first trained and certified in traffic safety.

Unless another penalty is specifically provided elsewhere in the Code or in a law of the State or Federal Government, any person who violates any provision of this chapter, any other chapter of this Code or any other ordinance of the Borough, shall, upon conviction, be punished by a fine of not more than one thousand ($1,000) dollars. Each day that such violation continues shall be deemed a separate offense.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING SIGNS are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets or highways of the Borough of Woodland Park, an emergency shall exist and no vehicle shall be parked on any street or highway or any portion thereof whereon signs are posted stating "NO PARKING WHEN ROAD IS SNOW COVERED."
The aforesaid parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parking or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

In the event a vehicle is towed, any fees incurred in connection with the towing process will be the responsibility of the registered owner of the offending vehicle.

Violation. Any motor vehicle operator who violates the provisions of this subsection will be fined fifty-five ($55) dollars.
If any motor vehicle operator is found to have violated this subsection and refuses to pay the same, his or her driving privileges may be suspended by a Court of competent jurisdiction.

a. 
The Chief of Police, or his designee, is authorized to allow parking on Lookout Lane, Pershing Place or Kay Road, from 2:00 a.m. through 6:00 a.m., and any other street where parking has been prohibited in § 7-7, Parking, upon demonstration by the applicant of exceptional hardship.
b. 
"Exceptional hardship" shall mean the applicant is permitted to park on such street previously prohibited, in the following situations:
1. 
Medical necessity or infirmity, with medical proof of same.
2. 
Such other set of circumstances wherein, at the discretion of the Chief of Police or his designee, the waiver of the parking prohibition outweighs the necessity of its enforcement.
c. 
To be eligible for a parking permit, the owner or tenant of a residential property shall provide both proof of residency and a valid vehicle.
d. 
Registration for the vehicle parked at or in the vicinity of the residence location. The vehicle shall be registered to the residence location. Permits shall be issued for each vehicle separately.

Any person found to be in violation of this section shall be assessed a fine not to exceed fifty ($50) dollars.

a. 
As used in this section, the following terms shall have the meanings indicated:
GROSS VEHICLE WEIGHT RATING (GVWR)
The maximum operating weight/mass of a vehicle as specified by the manufacturer including the vehicle's chassis, body, engine, engine fluids, fuel, accessories, driver, passengers and cargo but excluding that of any trailers.
GROSS COMBINATION WEIGHT RATING (GCVW)
The maximum allowable weight of both the loaded tow vehicle and the loaded trailer that the tow vehicle can handle safely.
RESTRICTED ROAD
Any street, highway or roadway within the Borough of Woodland Park that is not a designated truck route is restricted from usage by semi-trucks and trailers in excess of 16 tons.
SEMI-TRUCKS AND TRAILERS
Any motor vehicle, truck, or tractor and trailer combination capable of carrying cargo, whether loaded or not, capable of carrying loads exceeding 16 tons.
b. 
Any word or term used and not defined in this section shall be construed to be defined in accordance with its common or standard definition.
All roads within the Borough with the exception of those designated by New Jersey Department of Transportation, the Passaic County Division of Roads and Andrews Drive as a truck route.
The following described streets or parts of streets are hereby designated as truck routes:

The Borough of Woodland Park shall procure and have posted MUCTD (Manual on Uniform Traffic Control Devices) approved signs in areas zoned mixed-use having both residential and commercial usage.
a. 
Vehicles using restricted roads for the purpose of pickup or delivery within the Borough of Woodland Park shall use the most direct route from and to an unrestricted road (truck route). Business located in mixed use areas (commercial/residential) must be able to accommodate deliveries and pickups within their property as not to obstruct the roadway. Vehicles not exempt shall not exceed a trailer length of 43 feet, a width of eight feet, a height of 13 feet, and a GCVW of 16 tons. Those in excess of one or more of the criteria may be subject to penalty, fines, impoundment and restitution for damages incurred.
b. 
Vehicle Exemptions:
1. 
Fire trucks and other emergency vehicles.
2. 
Borough of Woodland Park Public Works vehicles.
3. 
Contracted garbage and recycling service vehicles.
4. 
Road repair, construction or maintenance vehicles involved in road repair.
5. 
Vehicles used for public utilities, services or repairs.
6. 
School buses operating on regular routes.
If any designated truck route or portion thereof is under repair or otherwise closed, restricted use vehicles shall use other temporary truck routes as may be designated by Passaic County.
a. 
For a first violation, a fine of not less than $500.
b. 
For a second or subsequent violation a fine of not less than $1,000.
