The purpose of this chapter is to establish a uniform set of rules governing municipally-created authorities, boards, commissions, committees and councils. It is the intent of this chapter to implement the Citizen Service Act, N.J.S.A. 40A:9-9.1 — 9.2, and the Citizen Leadership Act, N.J.S.A. 40A:9-12.1, thereby establishing requirements pertaining to appointment of citizens and citizen participation in municipal authorities, boards, commissions, committees and councils. The terms of this chapter are intended to supplement the provisions of other chapters of the Winslow Township Code which establish and govern the appointment of members, terms of office and method for filling vacancies in the various municipal authorities, boards, commissions, committees and councils.
A. 
The terms of this chapter shall apply to the appointment and/or membership of every citizen to any and all authorities, boards, commissions, committees and councils established by the Mayor and/or Township Committee, whether such appointment is made by the Mayor or governing body and whether such appointment is memorialized by resolution, ordinance or mayoral appointment/decree.
B. 
The terms of this chapter shall apply equally to any and all existing authorities, boards, commissions, committees and/or councils as well as those hereafter created or established by the Mayor and/or Township Committee, including but not limited to the following:
(1) 
Board of Health of the Township of Winslow;
(2) 
Celebrations Committee;
(3) 
Clean Community Committee;
(4) 
Drug and Alcohol Alliance Committee;
(5) 
Economic Development Council;
(6) 
Environmental Commission;
(7) 
Human Relations Council;
(8) 
Park and Recreation Advisory Board;
(9) 
Winslow Township Planning Board; and
(10) 
Winslow Township Zoning Board.
Any person interested in service on a municipal authority, board, commission, committee or council shall file a one-page form, entitled "Citizen Leadership Form," with the Clerk of the Township expressing interest in public service. A copy of the Citizen Leadership Form to be used pursuant to this section shall be kept on file with the Township Clerk and shall be available to interested citizens free of charge.
A. 
Upon appointment, every new appointee to an authority, board, commission, committee or council shall be sworn in by the chairperson of their respective authority, board, commission, committee or council or by another person authorized by law to administer oaths. The oath required by this section shall be administered in addition to any other oath required by law or specially prescribed by resolution, ordinance or mayoral decree.
B. 
The chairperson of an authority, board, commission, committee or council shall have the power to administer the oath of office required by this section to any person appointed to that authority, board, commission, committee or council.
A. 
The Clerk of the Township of Winslow, or his/her designee, shall compile and maintain, on an on-going basis, a directory of municipal authorities, boards, commissions, committees and councils. The directory required herein shall include, but not be limited to, the following information for each municipal authority, board, commission, committee and council:
(1) 
The name of the authority, board, commission, committee or council;
(2) 
The number of members or positions;
(3) 
A list of currently-appointed members and their terms of office;
(4) 
Vacancies;
(5) 
General frequency of meetings;
(6) 
Attendance of each member at each meeting held; and
(7) 
The appointing authority and the enabling statute, ordinance or resolution, if any.
A. 
The office of any person appointed by the Mayor or governing body to any authority, board, commission, committee or council, shall be deemed vacant:
(1) 
Upon its being so declared by judicial determination;
(2) 
Upon the filing by such officer of his written resignation;
(3) 
Upon the refusal of a person designated for appointment to such office to qualify or serve;
(4) 
Upon the determination of the appointing authority that such officer shall have become physically or mentally incapable of serving;
(5) 
Upon the death of such officer;
(6) 
Upon the determination of the appointing authority that, in violation of a lawful residency requirement, such officer no longer resides within the corporate limits of the township;
(7) 
In the case of a member of an authority, board, commission, committee, council or other agency, whenever the member, without being excused by a majority of the authorized members of such body, fails to attend and participate at meetings of such body for a period of six (6) weeks or three (3) consecutive meetings, whichever shall be of longer duration, at the conclusion of such period; provided, however, that such body shall notify the appointing authority in writing of such determination; and provided further that such authority, board, commission, committee, council or other body may refuse to excuse a member only with respect to those failures to attend and participate which are not due to legitimate illness; and
(8) 
Upon the removal of such officer for cause in accordance with law, or for any other reason prescribed by law.
B. 
Whenever any of the above shall occur, the appointing authority shall forthwith fill the office for the unexpired term in the manner prescribed by law; provided, however, that in the case of a person failing to qualify or refusing to serve pursuant to subsection (A)(3) above, such office shall not be deemed vacant if the incumbent officeholder is authorized by law to continue in such office until a successor is appointed and qualifies therefor.
