The cost of transmitting electronic records on a media (i.e. computer disc, CD-ROM, DVD and Digital Photographs) shall be limited to the actual cost of that media, except as further outlined in Article II of this Chapter, Entitled "Public Records Request".

Materials Containment and/or
Clean-up Fees:
|
Hazardous or other materials containment
and/or clean-up costs, damages, personal injury and/or property damage
costs incurred by the Township of Winslow or its employees or organized
volunteers in the course of their employment or volunteered duties,
as result of an incident, accident, spill, leakage, seepage, unintentional
or intentional act upon any lands, waters or properties within the
Township of Winslow, where, at the discretion of the Township, certain
actions were necessary to cause the containment and/or cleanup of
materials, hazardous or otherwise, to protect the health, welfare
and safety of the inhabitants and their property or belongings, shall
be the responsibility of the person, persons, or entity causing the
incident that required said containment and/or clean-up actions and
costs.

The fee for such containment and/or
clean-up actions shall be the actual costs incurred by the Township
and/or its volunteer organizations plus administrative costs as calculated
and determined by the Office of Administration or the Township of
Winslow, based on departmental reports submitted thereto, and to the
extent the Township of Winslow and/or its volunteer organizations
were involved. Said fees shall not be considered all-inclusive. It
is recognized other agencies from federal, state, county and/or local
government may have certain additional authorities and incur costs
under such matters which are not represented in fees herein, nor are
any fines, penalties or special assessments as a result of any enforcement
action at any level of government.

Nothing herein shall be construed
as the Township of Winslow being responsible and/or accepting responsibility
for containment or cleanup of hazardous or nonhazardous materials
identified on any lands or waters therein.

Police Records Court Discovery:

(1)
|
All requests for discovery in matters pending in the Township
of Winslow shall be submitted through the office of the Municipal
Prosecutor.
| |
(2)
|
In accordance with New Jersey Court Rule 7:7-7(i), the following
fees shall be payable by the party requesting discovery from the Township
of Winslow:

(a)
|
0.05 per letter size per letter size page or smaller.
| |
(b)
|
0.07 per legal size page or larger.
| |
(c)
|
If the Prosecutor/police records supervisor can demonstrate
that the actual costs for copying discovery exceed the rates set forth
in paragraphs 2(a) and/or 2(b) above, the Prosecutor/police records
supervisor shall be permitted to charge a reasonable amount equal
to the actual costs of copying. The actual copying costs shall be
the costs of materials and supplies used to copy the discovery, but
shall not include the costs of labor or other overhead expenses associated
with making the copies, except as provided for in paragraph (5) below.

(d)

mail.

photographs will be photocopied at the actual costs. Actual
photograph reproductions will be prepared and provided only upon separate
requests and advanced payment for the actual cost of reproduction.

Where the discovery must be obtained from an entity other than
the Township of Winslow, e.g., another police department, the actual
cost incurred in making the copy shall be charged to the party requesting
the discovery.

(4)
|
If the Prosecutor/police records supervisor can demonstrate
that the actual costs for copying discovery exceed the foregoing rates,
the Prosecutor/police records supervisor shall be permitted to charge
a reasonable amount equal to the actual costs of copying. The actual
copying costs shall be the costs of materials and supplies used to
copy the discovery, but shall not include the costs of labor or other
overhead expenses associated with making the copies, except as provided
for in paragraph (5) below.

Special Service Charge for Printed Copies. Whenever the nature,
format, manner of collation, or volume of discovery embodied in the
form of printed matter to be copied is such that the discovery cannot
be reproduced by ordinary document copying equipment in ordinary business
size, or is such that it would involve an extraordinary expenditure
of time and effort to copy, the Prosecutor/police records supervisor
may charge, in addition to the actual copying costs, a special service
charge that shall be reasonable and shall be based upon the actual
direct costs of providing the copy or copies. The defendant/requesting
party shall have the opportunity to review and object to the charge
prior to it being incurred.

Electronic Records:
| |
(a)
|
Electronic records and non-printed materials shall be provided
free of charge, but the Prosecutor/police records supervisor may charge
for the actual costs of any needed supplies such as computer discs.
| |
(b)
|
If the defendant requests an electronic record: (1) in a medium
or format not routinely used by the Prosecutor/police records supervisor;
(2) not routinely developed or maintained by the Prosecutor/police
records supervisor; or (3) requiring a substantial amount of manipulation
or programming of information technology, the Prosecutor/police records
supervisor may charge, in addition to the actual cost of duplication,
a special charge that shall be reasonable and shall be based on (1)
the cost for any extensive use of information technology, or (2) the
labor cost of personnel providing the service that is actually incurred
by the Prosecutor/police records supervisor or attributable to the
Prosecutor/police records supervisor for the programming, clerical,
and supervisory assistance required, or (3) both. The defendant/requesting
party shall have the opportunity to review and object to the charge
prior to it being incurred.

Subpoena Fees:
| ||
If any full-time employee or official is subpoenaed to give
testimony in a civil case the party issuing the subpoena shall reimburse
the Township for the time and fringe benefits of the employee or official
according to the following:

Time of the employee or official.
| |
(1)
|
If the employee or official is on duty for that day, the party
issuing the subpoena shall reimburse the Township at that employee's
or official's hourly rate of pay.

(2)
|
If the employee or official is off duty for that day, the party
issuing the subpoena shall reimburse the Township at one and one-half
(1A 1/2) times that employee's or official's hourly rate of pay.

(3)
|
Time of the employee or official shall include all time required
for proper response, including time for testimony, preparation and
travel.
| |
B.
|
Fringe benefit of the employee or official. The fringe benefits
of the employee or official shall be calculated as thirty-five percent
(35%) of the time spent for proper response at that employee's or
official's hourly rate of pay.

Any and all fees are to be collected
only by department heads and board secretaries of the Township of
Winslow, and/or those employees bonded and duly assigned by said department
heads or board secretaries. All fees collected shall be submitted
to the Township Treasurer on a daily basis.

The statutory fee schedule set forth
in N.J.S.A. 47:1A-5 shall apply to routine requests under the Open
Public Records Act, and is adopted and incorporated herein by reference.
As of the effective date of this
Article, fees under N.J.S.A. 47:1A-5 for routine copies of municipal
documents are:
Per letter-sized page and smaller
each: $0.05
Per legal-sized pages and larger
each: $0.07
Nothing in this Article shall require
the custodian of documents or any other municipal official to examine,
analyze, tabulate, or interpret documents which are subject to production
under the Open Public Records Act.
A.
Charges authorized. The Township Clerk
or other custodian or keeper of documents qualifying for mandatory
production as "government records" under the Open Public Records Act
shall be entitled to special service charges and/or special charges
as set forth herein.
B.
Requests to be in writing. Any request
for documents shall be made to the Township Clerk on a form established
by the Township Clerk for such purposes.
C.
Advance notice of fees, special service
charges and special charges; deposit. Any requestor of government
records which are eligible for the imposition of a special charge
or special service charge herein shall receive advance notice of the
amount of fees and charges before any work is started. The Township
Clerk shall require prepayment of such charges before causing the
work to begin.
D.
If a request for government records involves
production or conversion of digital or computerized records of film
which is in a medium not routinely used by the Township (i.e. electronic
or film), not routinely developed or maintained by the Township, or
requires a substantial amount of manipulation or programming of information
technology, the requestor shall pay fees and special charges as follows:
(1) Actual costs (no overhead) to comply with the request; plus (2)
Any special service charges for the actual labor required to comply
with the request.
A.
Duplication or other work beyond capability
of municipal-in-house work force. Whenever the in-house municipal
work force or available municipal equipment is insufficient to duplicate
or produce government records in a timely fashion, the Township Clerk
may cause such duplication or production to be accomplished by outside
vendors such as copy centers or producers of digital images. If the
costs of such duplication or production charged by such vendors exceeds
the routine charges set forth in N.J.S.A. 47:1A-5, the actual direct
cost of same without any additional surcharge for labor costs shall
be paid by the requestor of such record.
B.
Special service charge authorized. Whenever
government records cannot be reproduced by regular copying equipment
or fulfillment of the request would involve extraordinary time and
effort (for example, where a large number of records must be recovered
from storage or substantive staff time is required to review, sort
and assemble records), charges may be imposed as follows:
(1)
The actual cost (materials and supplies
but not staff labor) of duplication or reproduction; plus
(2)
A special service charge equal to the actual
direct cost of labor incurred by the Township, which may include the
reasonable costs attributable to the participation of supervisory
personnel when necessary. The Township Clerk shall endeavor to utilize
the least expensive means to accommodate the request.
The Township Clerk may waive the
fees or other charges if the requestor of government records is a
government or educational entity.
