Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

1. 
Findings and Purpose. The Borough of New Stanton finds that:
A. 
Certain residential areas or mixed residential/commercial areas in the Borough, as identified in this Part, are subjected to commuter vehicle parking and/or business patron parking, thereby depriving the residents and their guests of safe and adequate parking spaces or areas in which to park their vehicles.
B. 
Those residential areas or mixed residential/commercial areas, as identified in this Part, typically do not have sidewalks and are subject to a high volume of traffic which substantially reduces the safety of those using the street systems, the safety of pedestrians in the areas, and the quality of the ambient air level.
C. 
Businesses in or near these areas have, or are required to have, pursuant to other ordinances of the Borough, adequate off-street parking spaces for their patrons, and therefore, the establishment of a parking permit program for these affected areas should not adversely affect businesses in or near these areas, should facilitate the safe and efficient movement of pedestrian and vehicular traffic, and shall generally promote the health and welfare of the Borough and its residents.
2. 
Definitions. For purposes of this section, words and terms listed in this subsection shall have the following meanings:
COMMUTER OR PATRON VEHICLE
A vehicle parked in an area designated under this Part as a residential permit parking area which is owned and registered to a person who is not a resident of that area, or who is not a guest of a resident of that area.
GUEST
A person who is visiting, on a temporary basis, a resident of a residential permit parking area.
PROPRIETOR
A person who owns or leases real estate within a residential area of which he/she is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence or bona fide occupancy, or both, at that address.
RESIDENTIAL PERMIT PARKING AREA
An area, designated in this section, containing public and private streets, roads, highways and alleys or parts of the same, which primarily abut or are reasonably near residential property or nonbusiness property, such as schools, parks, places of worship, hospitals, nursing or personal care homes, and similar uses and occupancies.
RESIDENTIAL/COMMERCIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by a combination of residential property and commercial properties.
3. 
Criteria. The residential areas or mixed residential/commercial areas identified in Subsection 4 of this section are those areas deemed impacted and hence eligible for residential parking on the basis of the following criteria:
A. 
The areas have limited off-site parking spaces or areas available for residential parking and patrons of commercial establishments in the area or commuters have been found by the Borough to be utilizing on-street parking in close proximity to the residences in the area, thereby creating traffic congestion, illegal parking and related traffic and safety hazards for vehicles and pedestrians.
B. 
Residents in the area have consistently complained to and the Borough Council finds that the patrons of commercial establishments in the area or commuters have consistently parked vehicles on public streets in the area in such a fashion, manner and frequency as to create substantial traffic congestion and related safety and traffic hazards for vehicles and pedestrians.
C. 
The residents in the areas identified are severely and negatively impacted by the noise and air pollution caused by such nonresidential parking and by destruction to their properties.
D. 
There is a need and the Borough Council finds that there is a particular need in each of the areas designated in Subsection 4 of this section for residential permit parking in proximity to the residences located in the area to provide them with a safe place and area in which to park.
4. 
Designation of Residential Permit Parking Areas.

B. 
Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
5. 
Application for Permit. Application for a residential parking permit shall be made to the Secretary or other Borough official or employee so designated by the Borough Council by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle, who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, set pursuant to resolution of the Borough Council, which shall be for the use of the Borough to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Secretary or other Borough official or employee so designated by the Borough Council, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
6. 
Issuance of Permit. Upon receipt of the application and the permit fee, and determination by him/her that the information upon the application shows that the applicant is entitled to a residential parking permit, the Secretary or other Borough official or employee so designated by the Borough Council shall issue to the applicant a residential parking permit which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number, and the expiration date. The permit shall be renewable annually, before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
7. 
Temporary and Exemption Parking Permits. Temporary parking permits may be issued by the Secretary or other Borough official or employee so designated by the Borough Council, upon payment of a fee established pursuant to a resolution, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
8. 
Responsibility of Permit Holder.
A. 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him/her in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
B. 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder form the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
C. 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
D. 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Secretary or other Borough official or employee so designated by the Borough Council in order to obtain a residential parking permit.
(1) 
Revocation of Permits. The Secretary or other Borough official or employee so designated by the Borough Council shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him/her of the revocation, the permit holder shall surrender the permit to the Secretary or other Borough official or employee so designated by the Borough Council. Failure to do so, when so requested, shall constitute a violation of this section, provided any person receiving such a notice may, within 10 days after the date of the notice, appeal to Borough Council for a hearing on the revocation, and the decision of Borough Council shall be final.

1. 
New and Renewal Permit Application Processes:
A. 
Any resident of the Borough of New Stanton may make an application to the New Stanton Borough Council for a handicapped parking space after acquiring a handicapped license plate, placard, or a severely disabled veteran's license plate (hereafter collectively referred to as "handicapped").
B. 
All applications for new permits and renewal permits shall be submitted to the New Stanton Borough office and be accompanied by a copy of the placard or license plate and a copy of form MV-145A.
C. 
First-time applications for new permits shall be reviewed and investigated by the Public Works Committee of the New Stanton Borough Council. The Public Works Committee will make a specific recommendation for action on each individual new permit application to the New Stanton Borough Council. The New Stanton Borough Council will make the final determination regarding the granting of a handicapped parking space.
D. 
Affected neighborhood residents living immediately adjacent to the proposed location of the handicapped parking space shall be notified by the Borough, and comments shall be solicited from them by the Borough Council or another duly assigned or designated Borough Employee as part of this review and evaluation process.
E. 
The Borough Public Works Committee shall review all applications for renewal permits and will make recommendations regarding the renewal of all existing spaces to the Borough Council.
F. 
Each applicant for either a new permit or a renewal permit shall complete an application form and provide all of the information requested in order for the application to be considered by the Public Works Committee and by the New Stanton Borough Council.
G. 
An incomplete permit application form may be cause for the Public Works Committee to recommend to the New Stanton Borough Council that it deny said application for a handicapped parking space.
2. 
Applications for Renewal Permits:
A. 
Each permit for a handicapped parking space granted by the New Stanton Borough Council must be renewed on an annual basis.
B. 
Except for calendar year 2009, applications for renewal permits shall be submitted to the New Stanton Borough office between January 2 and January 31 of each year.
C. 
In making final determinations regarding renewals of previously approved permits for handicapped parking spaces, the New Stanton Borough Council shall apply the criteria contained in this section.
D. 
Once a permit is not renewed for any reason, any application by the same applicant shall be considered as an application for a new permit and shall be governed by all provisions of this section pertaining to such new permit applications.
3. 
Handicapped Parking Space Permit Application Fees.
A. 
The initial fee for a new permit application shall be $10 if the new permit application is submitted between January 1 and June 30 and $5 if the new permit application is submitted between July 1 and December 31. Fees as set forth in this provision may be changed by the Council from time to time by resolution of the Council.
B. 
The fee for each subsequent renewal permit application shall be $5 per year. The fee set forth in this provision may be changed by the Council from time to time by resolution of the Council.
C. 
All fees for handicapped parking space permit applications (new and renewal) shall be paid to the Borough of New Stanton within 30 days of the approval of the permit application by the New Stanton Borough Council.
4. 
Location of Handicapped Parking Spaces.
A. 
No more than two handicapped parking spaces shall be located on any block where parking is permitted on both sides of the street.
B. 
No more than two handicapped parking space shall be located on any block where parking is permitted on only one side of the street.
C. 
All handicapped parking spaces authorized prior to the effective date of this section shall be permitted to remain as located but must be renewed annually beginning July 1, 2009.
D. 
An application for a handicapped parking space permit may be denied if adequate, handicapped-accessible off-street parking is available to the applicant.
E. 
In the event that previously approved and permitted handicapped parking spaces exceed the maximum number of such handicapped parking spaces allowed per block, as specified above, the New Stanton Borough Council will not grant any such additional handicapped parking space permit applications in that block until the number of handicapped parking spaces falls below the maximum number of handicapped parking spaces allowed.
F. 
Any approved handicapped parking space shall be located at such place as designated by the New Stanton Borough Council and shall be located, marked and identified in accord with all other ordinances, laws, rules or regulations.
5. 
Revocation of Permit. The New Stanton Borough Council, upon specific recommendations from the Public Works Committee, reserves the right to revoke any handicapped parking space permit at any time.
6. 
Application Form. The form for application for a handicapped parking space shall be in the form as may from time to time be established and approved by the Borough Council.

Except as hereinafter provided, any person who violates any of the provisions of this Part shall, upon summary conviction, be ordered to pay a fine of not more than $100, together with costs, expenses and other sums expended by the Borough in prosecution of such offense.
A. 
Any person who violates any of the provisions of § 15-409 of this Part concerning residential permit parking shall, upon conviction, be sentenced to pay a fine of not more than $50, plus costs, expenses and other sums incurred by the Borough in prosecution of such offense; provided, however, that any person who violates any of the provisions of § 15-409 shall first be provided with a ticket, either by delivering such ticket to such person or by placing the ticket on the windshield or other secure area of the vehicle, informing such person of the violation(s) of the provisions of this Part and advising and offering such person an opportunity to avoid criminal proceedings by paying the sum of $50 to the Borough within 48 hours of the time and date of the violation as indicated on the ticket.
B. 
Any person who violates any of the provisions of § 15-402 of this Part on the following streets shall, upon conviction, be sentenced to pay a fine of not more than $50, plus costs, expenses and other sums incurred by the Borough in prosecution of such offense; provided, however, that any person who violates any of the provisions of § 15-402 on the following streets shall first be provided with a ticket, either by delivering such ticket to such person or by placing the ticket on the windshield or other secure area of the vehicle, informing such person of the violation(s) of the provisions of this Part, and advising and offering such person an opportunity to avoid, criminal proceedings by paying the sum of $50 to the Borough within 48 hours of the time and date of the violation as indicated on the ticket.

C. 
Any person who violates any of the other provisions of § 15-402 or § 15-403 of this Part shall, upon conviction, be sentenced to pay a fine of not more than $15, plus costs, expenses and other sums incurred by the Borough in prosecution of such offense; provided, however, that any person who violates any of the provisions of these portions of §§ 15-402 and 15- 403 shall first be provided with a ticket, either by delivering such ticket to such person or by placing the ticket on the windshield or other secure area of the vehicle, informing such person of the violation(s) of the provisions of this Part, and advising and offering such person an opportunity to avoid criminal proceedings by paying the sum of $15 to the Borough within 48 hours of the time and date of the violation as indicated on the ticket.
2. 
This Part 4 of Chapter 15 of the Code of Ordinances of the Borough of New Stanton shall be enforced by any police officer, the Mayor, or any personnel of the Borough so designated by resolution to enforce the same.
