All sidewalks, walkways, stairs, driveways, parking spaces and
similar areas shall be kept in a proper state of repair, and maintained
free from hazardous conditions.
In and on any public street, highway, avenue or alley in the Township of Winslow, the grade of which has been lawfully established or which hereafter may be established, gutters, curbs and sidewalks shall be set or reset, laid or relaid, altered, repaired, constructed and maintained in accordance with the requirements of Chapter 242 of the Code of the Township of Winslow.
A.
The owner, occupant or tenant of premises abutting any street in
the township shall at all times keep the public sidewalk, the area
between the public sidewalk and the curb or paved roadway and any
public right-of-way that directly abut such premises ("areas") free
from all weeds, limbs and branches of trees or shrubs, holes, pits,
loose stones, rubbish, paper, debris and other objects, and shall
otherwise keep the area described in this section free from obstructions
of all sorts. Nor shall any such person permit any grass or weeds
or any vegetation whatsoever, not edible or planted for some useful
or ornamental purpose, to grow or remain upon such areas so as to
exceed a height of six (6) inches or to throw off any unpleasant or
noxious odor or to conceal or harbor any filthy deposit, rodent or
other living creature or to create or produce pollen. Nor shall any
such person permit any such grass, weeds or vegetation to grow or
remain upon any portion of such areas in such a condition that the
grass, weed or vegetation is detrimental to the health, safety and
welfare of any inhabitant of the Township of Winslow. Any grass, weeds
or other vegetation growing upon any areas in the Township of Winslow
in violation of any of the provisions of this section is hereby declared
to be a nuisance and detrimental to the health, safety, cleanliness
and comfort of the inhabitants of the Township of Winslow.
B.
Whenever the pavement or surface of any public sidewalk or portion
thereof upon or along a public street or highway in the township shall
be found to be broken, disintegrated, uneven or otherwise defective
to such an extent that it would be likely to cause a pedestrian to
trip or fall in passing along the same, it shall be the responsibility
of the abutting property owner to make the necessary repair and/or
reconstruction of the sidewalk or portion thereof.
C.
Whenever the pavement or surface of any public sidewalk or portion
thereof upon or along a public street or highway in the township shall
be found to be covered by ice or two (2) inches or more of snow, it
shall be the responsibility of the abutting property owner or occupant
to remove said ice or snow within twelve (12) hours of daylight after
the same shall fall or be formed thereon.
