For the purposes of this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein:
LICENSEE
A person having a township license in full force and effect, issued hereunder, for a shooting gallery or shooting range.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
SHOOTING GALLERY
Any structure in which firearms, air guns, beebee guns or other weapons are fired or discharged and the entire act performed occurs within a structure.
SHOOTING RANGE
Any place, other than in a structure, where firearms, air guns, beebee guns or other weapons are fired or discharged; however, it includes any place where a portion of the entire act performed occurs partly within and partly outside of a structure.
STRUCTURE
Includes any building, dwelling, tent or other enclosure, whether permanent or temporary in construction, which has a roof or other overhead covering or enclosure.
TOWNSHIP
The Township of Winslow.
No person shall operate or maintain a shooting gallery or shooting range within the township without first obtaining a license, as hereinafter provided, from the Township Clerk.

Applications for licenses issued hereunder shall be made to the Township Clerk by completing a form setting forth and containing the following information:
A. 
The name, home address and business address or proposed business address of the applicant.
B. 
The type of shooting range or shooting gallery which is to be operated.
C. 
The identification of the block and lot numbers where the shooting range or shooting gallery will be located.
D. 
If an outdoor shooting range/gallery, a map or scale drawing identifying the areas where the shooting will occur and the buffer areas to be provided.
E. 
The type of targets to be utilized and the protective devices utilized.
F. 
A description of any procedure utilized for disposing of lead on the site.
G. 
A copy of the current insurance certificate identifying the types of coverage provided, to include environmental liability protection. The Township of Winslow should be named as an additional insured on the comprehensive liability policy and the environmental policy.
General liability: $1,000,000 (occurrence); $2,000,000 (aggregate).

H. 
The signing of a Hold Harmless and Indemnification Agreement in favor of the township.
I. 
Any other conditions as determined by the Township Clerk/Administrator for the issuance of the license.
The Township Clerk shall issue a license hereunder when he finds that the requirements of this chapter and of all other governing laws and ordinances have been met.
A license hereunder shall comply with the following regulations, requirements and standards of operation:
A. 
Except as provided herein, the licensee shall not permit the firing of any firearms, air guns, BB guns or other weapons at any time other than between the hours of 9:00 a.m. and dusk, local time, Monday through Saturday. The licensee shall not permit any such firing on Sunday or any day otherwise being a nationally observed holiday at any time other than between the hours of 1:00 p.m. and 5:00 p.m. or dusk, whichever comes first, local time. In the event the licensee owns forty-nine (49) or more contiguous and uninhabited acres, and said shooting gallery or shooting range is at least three hundred (300) feet from the licensee's property line and any residential or commercial property and at least one hundred (100) feet from any public road, then the hours of firing shall be from 9:00 a.m. to 8:00 p.m., local time, Monday through Saturday, and 10:00 a.m. to dusk, local time, on Sunday or any nationally observed holiday.

B. 
The licensee shall not admit any minor under the age of fourteen (14) years unless accompanied by and under the personal charge or supervision of an adult person.
C. 
The licensee shall not, either directly or indirectly, maintain, operate or carry on, or knowingly permit to be carried on by any person, on its premises, any form of gambling.
D. 
No person who is or appears to be under the influence of any intoxicating beverages shall be permitted in or on the licensee's premises, nor shall there be any intoxicating beverages permitted on said licensee's premises.

The license shall be issued to a successful applicant hereunder after payment to the Township of Winslow, through the Township Clerk's office a license fee of seventy-five dollars ($75). Said license shall expire on December 31 of the year in which it is issued. All annual renewals shall be at a license fee of twenty-five dollars ($25). Any inspection required of the facility and/or area to be used for the shooting range as determined necessary to process the application shall be at a cost of fifty dollars ($50).
A. 
The Township Committee shall have the authority to revoke or suspend a license issued hereunder when it finds that the licensee is operating in violation of this chapter or any other governing law or ordinances applicable thereto, after a written charge of such violation has been made and a copy thereof served on the licensee and a hearing is set and held thereon.
B. 
Any refusal or denial by the Township Clerk to issue a license shall be subject to review by the Township Committee upon written request therefor by the applicant to the Township Committee, filed within seven (7) days of such refusal or denial.

Any person violating any provision of this chapter shall, upon conviction thereof, be subject to a fine of not more than one thousand dollars ($1,000.) or imprisonment in the county jail for a term not to exceed ninety (90) days, or both.
