The Township of Robinson hereby adopts the International Property Maintenance Code, 2015 Edition, and any reference to "municipality" in said code are references to the Township of Robinson.
A. 
Section 103.5, Fee schedule, is as follows:
The property owner shall be responsible for all inspection costs, review costs and reasonable attorney's fees and court costs incurred by the Township in inspection, preparation of reports, citing and/or taking legal action to enforce the provisions of this ordinance.
B. 
The first sentence of Section 111.2, Membership of Board, is hereby revised to read as follows:
The Board of Appeals shall consist of not less than three members who are qualified by experience and training to pass on matters pertaining to property maintenance.
C. 
Section 111.7, Court review, and Section 111.8, Stays of enforcement, are hereby revised to read as follows:
Section 111.7. Court review. Any person who has been designated having party status at a hearing before the Board of Appeals shall have the right to appeal from the determination of the Board of Appeals within 30 days of the date of the determination of the Board of Appeals. If the Board of Appeals makes an oral determination upon motion at the conclusion of a hearing, the same shall constitute notification to the party of the determination and the thirty-day appeal period shall begin to run from that time. Otherwise, the thirty-day appeal period shall run from the mailing date of the Board of Appeals' written determination.
Section 111.8. Stays of enforcement. Appeals of notice to and orders of the Board of Appeals and/or to the Court of Common Pleas shall not stay the enforcement of the notice and/or order of the Code Official and/or any determinations of the Board of Appeals.
D. 
Section 302.4: height of grass and weeds shall be "in excess of 10 inches."
E. 
Section 302.8: add this exception:
Agricultural uses are exempt from inoperable or unlicensed vehicle requirements.
F. 
Section 304.2 shall read as follows:
Section 304.2. Protective treatment. All exterior surfaces shall be maintained in good condition. All metal surfaces subject to rust or corrosion shall be treated to inhibit rust and corrosion.
The Board may, by resolution and without adopting a new ordinance, adopt subsequent published International Property Maintenance Codes, provided the same are approved by the agencies of the Commonwealth of Pennsylvania. However, the same revisions set forth herein shall be revisions to any subsequently adopted code.
Any persons, firm or corporation who shall violate any provision of this article shall be sentence/ordered to pay a fine of not less than $600 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Whenever any person violating any of the provisions of this article is notified of such violation in writing by the Township Code Enforcement Officer, each day that a violation of this article continues or each section of this article which shall be found to have been violated shall constitute a separate offense. However, nothing herein shall abrogate the Township's rights nor prevent the Township from seeking injunctive relief, filing a civil action and/or pursuing any other remedy at law or inequity.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article. It is hereby declared as the intent of the Township of Robinson that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause section or part thereof not been included herein.
This article shall become effective five days after adoption.
