This section is created pursuant to N.J.S.A. 40:48-1 and N.J.S.A. 40A:14-156.1 and is adopted as a reciprocal agreement with all municipalities participating in the regional mutual aid compact. Pursuant to this Agreement, the Municipality of Lake Como shall render assistance to any participating municipality by providing equipment, manpower, goods and services, upon request of the local Emergency Management Coordinator, to help preserve each municipality's responsibility to protect and maintain the public health, safety and welfare of its citizens.
In the event that an employee of the Borough is injured while rendering assistance to a participating municipality, the Borough shall be primarily responsible for any costs incurred as a result of the injury. However, nothing in this section shall serve as a bar to the Borough from seeking indemnification from the municipality receiving assistance.
Equipment, manpower, goods and services, as described herein, will be made available to municipalities seeking assistance at no cost to that municipality when such equipment is available for assistance. However, when there is an emergency which will be eligible for reimbursement under a disaster declaration, the municipality providing equipment, manpower, goods and services shall be reimbursed at a scale set by the most current Federal Emergency Management Agency Rules and Regulations.
It is each municipality's responsibility to keep equipment properly maintained and available under this Agreement. In the event that equipment is damaged while rendering assistance, the municipality providing the assistance will be responsible for regular maintenance and repairs. However, it will be the responsibility of the municipality receiving assistance to replace goods and equipment lost or damaged beyond repair during the provision of assistance under this Agreement. If equipment is damaged through negligence or misuse, the party damaging the equipment will be responsible for repairs. However, nothing in this section shall serve as a bar to the municipality providing assistance from seeking indemnification from the municipality receiving assistance. Third party damage incurred while providing assistance will be covered by the municipality providing the assistance.
Any municipality that is not participating in the Monmouth Joint Insurance Fund shall provide a Certification of Insurance covering borrowed equipment and manpower prior to receiving assistance.
This Agreement does not preclude any participating municipality from entering into an agreement for equipment, manpower, goods or services with any other municipality in addition to this Agreement.
This section is separate and distinct from any mutual aid agreements previously entered between the Borough of Lake Como and any other municipalities and shall remain in full force and effect until specifically repealed by an affirmative act of the Governing Body after having given all other participating municipalities ninety (90) days' written notice of its intention to do so.
